Having a judgement -Still have yet to see the aftershocks

    As I indicated, the vast majority of judgments you may get against you, are not pursued. However, they are on your record, and if you wish to sell your property, or buy something new, that Judgment will pop up in a credit check.

    You *may* be able to discharge the underlying debt. However, the Judgment remains, and you must go to court to have it vacated. That will cost you more time and money on your part. Just filing BK, does not make a Judgment automatically go away.

    The case I presented above, was extreme, but is not all that unusual if you have an enemy that wishes to pursue you, and has the means to do so.

    I can tell you from first hand experience, that we have been on both sides of this situation.

      Awesome. I too have two judgments. One from crap one and the other from my former HOA. Crap one got a wage garnishment from a year ago at my part time job. However, I never grossed $290 in a week until last week, which I grossed $277 before deductions. $17 was deducted for garnishment. I thought $290 was the amount when garnishment kicks in. I, to don't see a reason to file yet, since it will not solve my back taxes yet. I can live with the little garnishment there and there. My other gigs have yet to be found out. I'm hoping that the two judgments will keep others from getting one. My credit report is toxic with a foreclosure as well. I have approached the three year anniversary when I first began to walk away from my debt.

        When I replied earlier I thought you had 1 judgment and your other accounts were in good standing, I thought good for you – keep up the hard work. Wow egg on my face.

        I don’t understand your thinking, you default on to many accounts to count, you believe you understand the law, you believe you are untouchable and you view a judgment as a scare tactic. Wow can I borrow those rose colored glasses?

        Please explain the thinking of how a judgment will detour your other creditors, I would love to hear this reasoning. Where in your vast knowledge of collection and lawsuits did you learn you could only be sued by one creditor?

        Did not realize that car you purchased at a good rate could be seized and sold to execute that judgment?

        Are you planning to keep 15.00 in your bank account for the next 10 years? While paying with cash is perfect way to go through life – but those check cashing, money order, cash transfers fees will add up over that 10 years.

        It sounds like you are in school, it fair to assume you will be applying for better employment once you graduate, what do think is going to happen when you have to submit for a credit check?

        I personally wouldn’t want to wait 10 years for my future to start.

            merime's glasses may be a little rosy, but what's wrong with that? She was at one time in a panic about her debt. But, she has decided not to let the pressure of her creditors cause her to rush into actions she is not ready to take. She seems to know she most likely will not be able to do this forever. When people have no assets to take and are not vulnerable to garnishment of their income, it is often suggested they not file BK right away.

            IMO, she has changed her attitude from fear to empowerment. This will serve her well when her creditors become less peaceful.

                No rose colored glasses, reading glasses lol. Of course I do not feel untouchable, but have learned judgments do not make your life stoppable, (if that is a word). Yes, I had more creditors due to living 18 years raising 3 kids as a trophy wife without the trophies. I never said a judgment was a scare tactic, rather a CREDIT SCORE. Hmm, well I defaulted on the other ones earlier than the one that sued me. The statute of limitations is up on most of them this Monday. I did agree with though if the CC companies see a judgment is uncollectable, they will not spend the money to pursue you. Now I may add, that if a "situation" changes and they can come after you and make a profit, it could be like feeding time at the zoo. That is why it is always smart to plan ahead. As for why I have so much debt, like many people on here it was not from living a life of luxury , or spending out of my means.

                As for my car, it is paid off and is not in my name. It is 100% safe from being seized. When I bought it I was surprised to hear the interest rate they offered me. That is when I thought to actually take a peek at my credit score. I was sure it was -100. It was over 700, which really surprised me. My judgment did not stop me from getting a student loan for my son at a low APR.

                As far as being afraid of an employer seeing my credit score, that really does not have me losing sleep. My ex husband, ( who works for a fortune 500 company) just hired someone who a poor credit report. The guy explained the situation, and is now working for over $75,000. I was able to get my current job which required a very detailed background check. In today’s world, bankruptcy does not carry the stigma it used to. Stuff happens, and even the best planners can become unemployed or lose their savings to an unexpected emergency. Its the very thinking of “Oh my Gosh my life is ruined forever”, that keeps people afraid to move forward. I um, is so valuable when it comes to learning to live your life while preparing to take charge of your future. Look over all the advice and while many do not apply to you, there always seems to be something to learn. My only debts are from CC, no enemies. In fact, I have made more friends along the way!                   merime, I have to say your story is encouraging!!! However, I guess you "lucked out" in the sense that there is no wage garnishment in NC - even if your credit sucks dirt (and mine does) why wouldn't a creditor sue and get a wage garnishment in states where that is possible???

                    Yes, I agree. I really do not know why a creditor would even sue in a non-garnish state, unless the person has assets. With me , legally there is nothing to go after anymore. Maybe I did luck out , but I do not always feel that way. There are always road bumps.

                      Thanks merime -forgive me I didn't mean to say that you "got lucky" but that it's less hard in a non-garnishment state. Because in NC, if you do what you did, there really isn't much they can do to you...

                          I forgot to answer the question about my bank account. I do not have any checking fees, money order or cash transfer fees. I pay all my bills the day that I get paid, so it is money in and money out. If you read these forums you will discover there are many ways to keep your savings safe from CC collectors.

                            They can come to your house with a sheriff and sell everything you have. BK cannot come soon enough for me. I want these people off my back!! When you get 1 they all follow. going through it. Sorry but they will get to you, I had 1 for about 2 years been paying then a couple more. I can't live like this anymore. I want to be free, even if it takes 5 years. You could only hide for so long. I am not being negative just truthful.

                              They can't take everything you have. Property exemptions apply in collecting a judgment just as they do in BK. Yes, a judgment creditor can bring a sheriff to your house for non-exempt assets. But, unless you have something pretty valuable, they aren't likely to do it. They don't want your used household items and clothing. They want cash.

                                Or, perhaps a car. 'Hub and I did that to the people mentioned in one of my earlier posts in this thread.
                                I went back and looked for it. See post #12.
