    DM, what address did you put in your bk application?? you live some place, don't you keep your cars nearby at least?

      The cars are a couple miles away. There's probably 30,000+ houses in this small area. No repo man is going to drive around at random hoping that they find the car. Now that I have officially filed, they are not going to come looking. The bank will have to get a legal court order for me to give the cars back at this point by lifting the automatic stay. I am not worried.

      I received a letter from my attorney in the mail today. They said I had to furnish a copy of my bank statement showing the bank balances from the day I filed until the last day of January since they are going to be using August of my official month of filing. They said I should receive the written notice from the court telling me the address of where the 341 meeting will be. So will I be joining the 60 day club after my 341 meeting? Is that when the ever famous count-down begins?

      All I need to do is keep both cars until late January 2010 and then we'll be able to put a sizable down payment. I am hoping to get any kind of Christmas bonus to give me a boost, plus whatever I can save up between now and then. It's trying to save up cash while making a car payment which makes it so difficult to buy a car. What I need is to drive a car for free for a long time so I can save up. I think this is a big problem for many people. All the money you put down on a car is less money that you will be paying interest on. So if I can finance $5,000 after all is said and done, I'll only be paying interest on $5,000 instead of $15,000. Then if I can pay $1,000/mo. for 5-6 months, my car will be paid off IN FULL and I won't be dragging around 3 years worth of car payments. Then I can worry about buying car #2 for the wife after I get some little $11,000 to $15,000 car to go back and forth to a day job.

        What about the insurance? So...I can take the plates off? I hope I can make it thru all of this stuff!!!

            The cars are parked in front of the house where I am temporarily staying at. Why would I walk to miles? The Mail Box Etc. place is over 2 miles from here. That's where I go to get the mail. All of my mail is forwarded there. NOBODY has the physical addresses where I actually am and it needs to stay that way. Everyone has the right to privacy. Its worth spending $100/yr. for that protection. If I ever need a UPS package delivered, it all goes there. I love this service!

              well! just be careful because the trustee will ask you under oath whether the address on your petition is where you live now. if you say yes, you are lying (nobody lives at Mail Box Etc.). if you say no they might require you to amend your petition. plus, if the repo person goes to repo and finds that the address is mail box etc, that creditor could report this particular scam to the trustee.

              i agree that we deserve to have privacy but unfortunately to file bk there are some rights that we give up.

              does your lawyer know that you don't live at the address you provided?

              i see now that you say you are "temporarily" staying there. does that mean you are not on any lease?

                No lease. Living with family.

                If the trustee asks if this is my address, I will tell him yes. If he asks if it's my "physical" address, I will tell him no. It all depends on how he asks the question. I won't lie.

                In my line of work, I deal with the public. I want no paper trails coming to my personal address. 100% of my correspondence goes to the mail box place. Netflix movies, you name it. They all go there. That way when I finally move to another place, I don't have to notify everyone of our new address. I will still be able to go back to the mail box place and get my mail no matter where I live.

                  ok, if you are living with family then you don't really have to give that address - your family is under no obligation to allow you to use their address as though it were yours.

                    Actually, the trustee requirements are to ask you to "state your name and current address for the record." I'd ask your lawyer how to respond if you don't want your address to be known.

                      Then I guess I don't really have an address then. They can kick us out of this place at any time. That's why I use the mail box place. We still have our furniture and stuff at the house that is in foreclosure. We've been here since last year since there are no jobs up north and everything is so damned far. I hate driving 30+ miles to a restaurant or grocery store.
