got a letter from a lawyer about my car

    because even if the trustee asks for something, you have the right to object (futile as it may be) so they can't go to a third party and ask for private information - they'd need approval from the court. also, in most cases it would take much longer because the cc companies have no stake in it, so they could delay forever.

    i guess you will have to go through life thinking negative thoughts all the time so that maybe something good will happen for you. but i would suggest to be at least cautiously optimistic.

      Funny, because that's EXACTLY what I have to do now. Almost 95% of the time, if I ever thought positive about something, the worst always came of it.

      The UST should give the bank 10 days to furnish the statements or just throw out whatever issue he had instead of wasting our time. These people need to learn to be efficient and that doesn't seem to be the case. Everything should be electronic and take no more than a day or two to process anything.

      I don't need 60 days to object to anything. All I need is one day and I'm done.

        Why should the bank go to the trouble of providing you with statements that will help you discharge the debt you owe them? Especially since they already gave you those statements as you racked up the debts. It's not their fault you lost them. You're the one filing bankruptcy, it's on you to provide the court with the information they need. You're going to get $350k worth of debt wiped away, so quit whining about having to make a few phone calls and get it done.

          Sorry, Skippy... not gonna happen. If they want to defend what I owe them, the burden is on them to prove that I owe it. They can go pound sand.

          If this BK doesn't go through, no problem. I will just live in South America. We have a nice place to stay there. Let them come and sue me there or try garnishing a wage there. GOOD LUCK!

            The trustee isn't asking the banks to defend what you owe them. You'll be the one pounding sand if you can't provide the documents. Just hope the sand doesn't get under those acrylics your wife can't live without. By the way, someone should let her know those went out of style with the 90's. ;-) I'm sure they look nice when she presses the button to play her Gloria Estefan cassette.

                Ok....since I don't have to go to crt about the car. What are some things I need to do to get the car ready for them to take? It is not registered....I still have insurance on it. The plates are still on it.The crt date is Aug 25...so about when will they come for it??? I'm scared.....

                  What are you scared of? Nothing bad is going to happen. The stay will be lifted around the time of the hearing, someone will call you, and then they will come pick up the car or ask you to drive it to them. Easy.

                      Just make sure all your personal items are removed from the vehicle. They will return the plates by return-mail. You have no worries here.

                        When they call you to get it or have you drive it there, take all of your personal belongings out of the car. If you live in a state where you have to turn in your plates, take off your plates. That's all you have to do.

                              We were told by our lender's lawyer that when they are repo-ing when the stay is lifted, they do call to arrange it. Our stay was lifted a week ago, and we are still waiting...it's been nice to have a car with no payments since March.

                                Who are they going to call? Me or my lawyer? I don't think any of my creditors have current phone #'s or addresses on me since I have moved and changed phone #'s so often.

                                I haven't made a car payment on my SUV since January. I wish I had the surplus of that to sock away but we've been living on it. Talk about a buzz kill.
