I doubt the creditors scrutinize the costs. I think they have a program that categorizes transactions, for example Carrabas would be dumped into the food category. Its too manpower intensive to scrutinize every transaction for every customer that files bk. They probably have internal controls for what they categorize as luxury items and there is probably a threshold on food.
If they want their $51 they have to file a claim. That requires a lawyer who will charge $100/hr. See, not worth their time. The creditor may file a claim pro se but they screw that up according to my attorney

In the big scheme of things, the IRS has some mathematical dollar allowance you get for food and the like...based on where you live and how many people are in your household. If you want to spent X at Carrabas even after you file, it counts against your food budget.

DM, you and your wife need to start living within your means. $51 dinners at carrabas and spa services on cards you knew you were about to file bankruptcy on? I guess you two are about to come to a harsh realization now that you don't have those cards to charge up anymore. This should get interesting when the UST gets involved, considering the large amount of debt you have.

And I agree with you. The card dependency should have been severed a long time ago and defaulted to the debit card. I have some complex issues on my bk filing but at least I can say with a clear mind that I have not used the cards since Feb. Everyone should wean themselves off their cards. Its tough when you used them to pay for everyday expenses--but you have to.

DM, Bank of America told me they cut my online access (mortgage; I closed checking accts with them) because the content would violate the rules for them as lenders during bk. I don't know if this will apply to your checking acct, but it's a possibility.
DSIG: Do you have any indication that USAA will drop you once your policy expires? Are you bk'ing any debt with USAA.
We are bk'ing a cc and a vehicle with them and we have our home and auto insurance with them. I am really hoping they won't drop us although I have read that they may.Ch 7 Filed: 4/27/09

I have no interest in reaffirming and while I do want to keep our insurance policies with USAA, it's not worth being on the hook for the auto loan and cc.
So I am NOT in good standing. Guess that means I'll get dumped when my policy runs out. They have allowed us to make changes to the policy during the bk, which surprised me.Ch 7 Filed: 4/27/09
