Pre-341 Trustee Phone Conference

I received my letter from the trustee introducing himself and requesting documents. At the bottom there is also a part where I have to call into a phone conference about a week or so before the 341 meeting.

Anyone else have to do this? It says that the lawyer can be on the call too, but I wondered if that was needed.

We are in middle district of FL, and did have a pre-trial phone conference with the trustee. Basic questions like "what led you to filing?", "does anyone owe you money?", "any other assets not disclosed?", etc... Your atty should be able to give you an idea of what they will ask, my atty was not on the call with me.

This is required and you may get stock questions. Ours was by his paralegal and not him as he was out. It is a formality, not to worry about. 'Hub

I guess it's the normal elsewhere but I have never heard of it and it did not take place with my case.

It is normal in some districts and not in others, it is routine and part of the bureaucracy so long as you have everything filled out truthfully then you shouldn't have any problems.

It did not happen here in my case in the Southern District of Fl.

Its is strange that the various districts are run so differently.

I filed on June 12th 09. Have Lawyer. He did not say anything about this. The only thing it says on my info papers is that tt may want tax rtns. I live in CO. Does anyone one know what else they may ask before 341? I already got picked for that ramdom audit. That is done.I'm scared so bad.....could not sleep last night. I'm low income. I have not even got my paper from the court with my court date yet. Although the Lawyers secretary gave me my case # and ct date. Soooo nervous.....

I think it depends on the district... some people have said they needed different things. I've only been asked to bring a bank statement as of the date I filed and pay stubs that cover the period up to the date I filed. Other people have been saying they needed receipts, 6 months of statements, statements from their credit cards...

OMGOSH.......when will you know all this??? Do you send it to them or bring it to court.I have my 341 same day as you. BK 7 too. CC debt is bout 27000.00, medical 4000.00, giving up comdo 77000.00 and car 10000.00. I lost job just before he filed and now living off of 1747.00 a month in alimony and retirement.Lawyer said it didn't matter and he didn't need to change anything on the papers.He said I will prob be a no asset case....cuz you clearly have no money...that is what he said. So freaking scared and nervous....this is consuming my whole life if seems like...you know>?

amy...the last day to object date.....is that on the paper you get in the mail with the ct date???? Cuz I have not got my paper yet???? I wonder why I have not got it yet?????

denisejohn, yes the last day to object date is on the paper you get with the date for the 341 meeting (which by the way is not a court date - it does not get held in a courtroom and there is no judge, only a trustee). the last date to object is automatically 60 days from the 341 meetinng. the paper is probably on its way - your district might be backed up. but you can see it if you go on pacer.

since you are "freaking scared and nervous" i would suggest getting a pacer account. you'll have more information, which tends to reduce stress. just be careful not to click your way into debt (it's 8 cents a page, so click on each document only once and save it to your hard drive, never to be clicked on again)

Its also listed on my pacer. That's actually where I pulled it off of.
