    tens of thousands over the median?

    i see someone started a poll for those who are over the median and still pulled off a chapter 7......

    now, im really trying to be objective here and not ruffle any feathers, but how do you pull off a chapter 7 when you are over by huge amounts?

    im under by 12k bucks, but do to excess SS, im toast... someone kindly share your secrets on deductions... my lawyer is clueless on any that arent starring him in the face...

    please share your knowledge!

    I would guess most have high secured debt... here is an extreme example:

    California Court: $6,060 Monthly Mortgage Payment Not an Abuse of Chapter 7
    Filed Chapter 7: 06/09/09
    341 Meeting: 07/16/09
    Discharged: 09/21/09
    Case Closed: 09/25/09

      thanks, i guess the question now is, how can i get some? what can i buy? i have 500 a month DMI..

        Married? Have two cars that you are making payments on? That $489 ownership expense per car adds up quick.

          nope, not married, maybe i should get on match.com.. that would solve my financial problems anyway...
          i did go out on a date with a BK lawyers secretary last night.. however, i didnt tell her i was thinking about BK..

          i asked my lawyer what i could buy that would help and he never returned my call...... it must be a touchy subject with lawyers..

            Your attorney cannot advise you "to incur more debt" in contemplation of filing a bankruptcy case. It's agaist the law for them to recommend it, even if it is perfectly legal for you to do so.

              alrighty then! i need some wise and clever individual to make some suggestions..

              its sort of like some people paying too much income tax, because they didnt have a good accountant....

              the woman i went on a date with last night, told me that her lawyer boss doesnt know squat about BK, but said shes taking advantage of the fiscal situation at the moment.. i feel sorry for her clients..

              where does one turn for advice, if the lawyers cant tell you?

                  There is an appeal working its way through the court on this issue. I believe the case originated in Texas, but is making its way to the US Supreme court regarding the means test. However, that case is more based on the difference granted by consumer vs non-consumer, but also touches on the issue of people in different region getting a different benefit because they happen to live in a more expensive area. Thus, they are arguing that the means test is unconstitutional.

                    good advice, however madame the scoundrel already has my money and hes not giving it back..

                    the first lawyer i went to, only got in my knickers for a hundred bucks, before i realized i was getting hosed...

                    if the trustee ever asks why i went BK, ill just say, too many lawyers...

                      Yep, buy a car. The payments plus, insurance, gas and maintenance expenses will add up in a hurry.

                        i already have a car.....
                        the first lawyers paralegal, told me that i could keep my motorcycle as a second car and claim the payment..

                        now, i know that sounds absurd, but back then i believed her... gawd help me if i had kept him for a lawyer.... kind of spooky, to think i had to pay to be told some BS like that....

                        kind of reminds me of a woody allen movie i saw... he was on death row and said they were going to hang him tomorrow.... he said he got a sharp lawyer and they wouldnt do it until friday...

                          Is the car paid for?
                          If not, sell it and finance something. It's a crazy thing to do but, as someone pointed out the way most over median filers are getting a discharge is, they have high secured debt obligations.
                          A $250/car nort plus insurance and gasoline and mainenance will eatup a lot do DI.
