    341 is over! They took our Stimulus Money

    Yeah..the 341 meeting is over with. You were all right..piece of cake. We will just wait for discharge.

    It was so disheartening to watch person after person have their stimulus money taken away from them...including us. We were expecting $1800 with which we wanted to start our savings account. We don't NEED anything right now, except a nest egg for emergencies...heck, that's what got us into this mess in the first place.

    He was almost smug about it...jerk. Smiling at us as he pushed the paper accross the table..."now you understand you'll be relinquishing your rebate check to me once you recieve that, if not..you will not be discharged and you will be responsible for all of your existing debt..."

    This is so frustrating!! I did hear there's an attorney in our town who is trying to fight this, but I'm sure all hope is gone for us and our money.

    I can understand that $1800 is a small price to pay for having $153K of debt wiped out, but why kick someone when they're down...especially an arrogant lawyer who has been appointed as trustee. JERK.

        First of all Congratulations on making it through the 341!! It has to be such a relief to be on the other side now....
        So sorry about your stimulus. The more I read here the more I see that most are really taking it. I like how you summed it up though "JERK". There definately seems to be some human greed happening because normally no asset chapter 7 these trustees get almost nothing. This is like winning the lottery for them because they get their 'administrative fee' right off the top. I read somewhere that its like 60%! So the creditors really arent going to be getting much. Just think how much money the trustees are now making in a day....

        I really was hoping that some light would come to this and it would be headed off before it started. Even for the average person would you really step over a $20 bill lying in the middle of the road? Now imagine $600 or $1800 and so on.

          Congratulations on that being over I am with you on the stimulus check, it's a windfall for the trustee our attorney said the trustee will get the "lions share" of any $$ she collects.

              What does the Trustee do with the money? Where does he send it? Does he keep it... Literally?

                I dont think anyone is arguing about it being a small price to pay. Your correct but why should we have to pay? Its the whole point behind it. If "the idiot in office" <-- as you put it hadnt offered it in the first place it wouldnt be there for the trustee either. Why should someone else benefit? Its not like much of its going to pay a creditor back after administrative(trustee) fees.
                Not to mention we are all taxpayers as well. So its a gift to ourselves as you put it.
                You also need to take into consideration that the whole bankruptcy is not just about wiping out debt. Its also about those of us who have lost jobs... pay cuts... medical issues...etc. Just because the debts are gone doesnt mean that the same amount of money is there as when the debts were incurred. This stimulus money meant new shoes or a fridge of groceries for some of us.

                    We spent our refund on our attorney, had a whopping $40 left over. We blew that $40, we actually went out for supper, it was valentine's day and we had just left the attorney's office having paid him in full, $1324.00. It was sort of a celebration dinner.

                    Stimulus will be ours. We are spending it wisely and keeping all our receipts. I know it's a unexpected gift, but it should go in our pockets not the trustees. Won't they get their own check why do we all have to give them ours?? I know stupid question, but honestly it just seems so wrong when you think about what the check was intended for and what those trustees will use it for. To repay cc, doesn't that seem so wrong??

                      That was really well said. Its the whole getting kicked while you are down thing. Most of us going through BK have already had our share of misfortune and just plain bad luck so go on ahead and take that little bit of something we might have had go our way. Since we didnt need our wildcard exemption as we have nothing to exempt- our lawyer was able to account for ours. My heart goes out to those having to fork it over- it just ain't right.

                        I haven't filed yet, so I will spend my stimulus when I get it. But if I had filed and they wanted the stimulus, I would be happy to give it to them as long as my debt is wiped clean.
                        And w/out the debt my life will be much easier.

                        ETA: I was told by my attorney that I don't have to worry about tax refund or stimulus.

                          I am signing my papers and filing on Monday, my lawyer told me yesterday that they would be taking the sitmulus. I told her that I still owe the IRS $1492.00 (I already paid $1500) so it looks like they will take the money before the trustee gets a chance. I am so glad I didn't pay the whole amount, I was counting on the stimulus to cover the rest and it looks like it will work in my benefit.

                            Agreed. I have on multiple times called the trustee taking our stimulus check as our "penance" or our (snicker) "stupidity tax".

                            If he could at least let us keep the part that was supposed to be for the children it would have been nice. They shouldn't be punished for their parent's misfortune/stupidity.

                            But what is done is done. No sense fighting the system, you only die tired that way.

                              Trustee wants mine, he said to foward him the unsigned check. I recieved it via a direct deposit, how should I send it to him? In a money order or??????????
