But there is a vast difference in the stories here.
It sounds like the old Col got a little carried away and frustrated to me over being served.

From the article it says "But Leech has a different take on it. He says the process server wouldn't leave when Leech ordered him to and instead, stood inside the home's courtyard "yanking" on a locked inner gate demanding to see Leech's identification."

When you tell somebody to leave and they will not, and they are yanking on your locked gate, I would say the intruder had stepped over the line. At that point, the server would be probably guilty of tresspassing. If he kept up trying to enter the property, maybe he could be charged with endangerment or something similar.

And likewise you must play the devil's advocate and look at the other side. The company that hired the guy that served him stated he was one of the most mild mannered they have.
The fact remains in this state you cannot pull a gun unless you are endangered and an unarmed man does not constitute a threat in most cases.

Ken I know we have had minor differences in the past but on this issue you are a man after my own heart. So maybe I was a bit harsh and if so, I apologize. Growing up in Nashville I remember a creek behind our home and the "teenage" cool kid that was envied by all of us was jerry along with his friends. There in suburbia, right below Cheekwood, once home of the Maxwell House coffe family who once owned the valley we lived in Jerry and his two friends would walk dowb the river hunting snakes. Never once did the ever point a gun at one of us, or joke about "blowing us away" and such. They were trained by fathers who had likely been to war like mine.

It was a fenceless suburbia, it was not perfect, but a different country. I live in a Townhome. I do not own a handgun. I won a Remingtonn 597 22 Cal. and beloved Ruger 22. My youngest is the expert, I simply own them because the Dems. and Ken Jenny our now jailed for corruption ex-sheriff told me I shouldn't have the right. That rankled me no end. I own a piece of land in AZ, out where it's real cheap near Holbrook. So, it ain't a brag. My wife refuses to dump it. She works for the Attorney General here and knows some of the firearms laws in TX, AZ, FL (obviously) and a host of others. She refuses to dump the place in AZ just because of that law.

I think your point that this has become a violent, disrespectful culture is well put just by posting that article.

The boys mentioned always carried three 22 rifles.

Bigjohn I concur... boneheads don't understand the shred of dignity is our own toadstool.

I had to swallow hard a lot of years ago in a job I had and had to learn to look at both sides before making judgement.
I admit I don't always take the time to make the right judgement myself in all matters like most.
I posted this article in the hopes that some might realize that we must think before we act in these hard times.
While pulling a gun and maybe shooting someone might seem like the right thing to do at the moment to vent the problems many of us have suffered recently it could just give you a lot more problems and more than you want to deal with.
People that come to take cars and serve notices are working for a living too.
Some do commit crimes, that's for sure. But they too can be addressed.
I just thought this article might invoke some thought here before someone gets themselves into trouble that they may not be able to get out of.
A a veteran of a combat era I know what it takes to kill and a threat by pulling a gun you cannot use is just plain stupid.
                  Food for thought folks~~~

I sort of agree with this however our city has the highest crime rate in the nation per capita, how do you know they are not armed?? Most here are...everyday I read the paper and just about every traffic stop winds up finding them in possession of firearms even as young as 12...you just don't know if they say who they are then its ok, but to demand and shake the gate or pound on the door they're are going to be consequences.

People carry guns for self defense either concealed or open carry as permitted for various reasons.
You simply cannot assume they are armed or see that they are and intend to do you hard and pull a gun. Point made.
That's not an excuse for the 12 year old gang banger either. But paranoia comes into play too.

Ken.. I hope my post didn't come off as.. " shoot now and ask questions later" , that's not how i wanted it to come across. Yes your right, the old guy may have over reacted a bit, but to be fair, you still have a right to protect yourself and your family.. In the world we live in today, how can you not have a gun and protect what you have worked so hard for, not to mention your family.. thats just my two cents and it may not be much

I don't think the old guy over reacted, I think he might have been 'going by the book'. He told the guy to leave. the guy didn't. Instead, the guy continued rattling the gate. At what point can a gun be used? If the guy broke down the gate, I would say a weapon could be used. You still have the right to protect yourself in Arizona.

Just a few weeks ago in Arrivaca, Arizona some people barged into a home, killed a nine year old girl and her Father. The mother survived by wounding one of the men. This kind of crap goes on in Arizona on a regular basis. Not good.
