    question

    Hello Me n My husband lives here in california.
    I just have a few question.
    When the DISCOVER (credit card ) started garnishing my husband's check from work. for about a year.

    My employer never tell me about it, only after i seen his check.
    We got his check and wondered why its not enough and my employer said
    oh coz the credit card company you owed is collection money. and it is now attached to his wage.

    Now can i complain to my employer or the accounting or financing department for letting them take my money without further to me and only told me only when i asked? They did give me some note that the creditor sent to my employer but that was already when they have taken the money.

    I believe if he was told before they did, i could have had an option to contact discover and made my own arrange by aggreeing that i will pay through money order or bank n not from his wages coz they base on the income. 25% of the the gross income.


    Who should i contact regarding this matter.
    is there any possibility that i can have those money back or have my employer settled with me for not telling me first any suggestions? thank YOU!
    a lady told me that the collection can give my money back at least if not all percentage of it? if its true its gonna be great if not.. what about my accounting department who handed my payroll number and info

    In order for your wages to be garnished, the credit card company must have a judgement against you. To get a judgment, they would have had to sue you. In order to garnish, the creditor has to get a court order to garnish your wages.

    Your employer must obey a court order. Go to the courthouse or look on line in your district to find out when the judgement was issued.

      I'm confused. Do you and your husband work at the same place? It should have been your husband to tell you. The employer faces confidentiality problems telling anyone even a wife about payroll history. "Startingover08" spoke true that you must have known that Discover sued you. Did you know that they did? Didn't you get many past due notices about not paying on the card long before Discover started taking money out of your husbands wages? Please keep track of what your husband wages are paying back to Discover, so they won't take out more than they are owed. 'Hub
