    Debtors trying to collect after discharge....

    I need a answer on this question Please.........
    Before filing and completing my Bankruptcy chapter 7, I used credit cards for some purchases, and now that I filed including the credit cards for debt relief, the credit card companies aren't bothering me, its the stores where I made the purchases, is this legal, seems how my bankruptcy went through, and is now discharged? any information would help alot. thank you

    I didn't list the stores persay, on my Matrix, just the creditcards themselves,, thank you

    Why would the stores be bothering you??? Did you purchase anything from them like computer at Best Buy, lawnmower from Sears????

      The only way the store could legally collect the account is if they carried the financing themselves and were not included in your list of creditors. Most stores use 3rd party finance companies to finance merchandise. It is very rare for a company to carry their own accounts, although not out of the question. If the account was not listed they can legitimately attempt collection. Federal law requires that upon initial contact by a debt collector you have a right to dispute the debt. The creditor is then required to provide proof of the validity of that debt. If they do not and the collection efforts persist send them a certified letter demanding they cease and desist all contact. If they then persist trying to collect an invalid debt, hire an attorney to file suit against them and report them to the State or US Attorney General.
