    Filing soon. Who do I list? Original creditors, collection agencies, both?

    It looks like I'm filing for a Chapter 13, which I kinda figured I would. Tomorrow I'm meeting with my attorney to update my records, as I originally retained him over two years ago, and the only information I've updated since then is my current income. He's got me at $500 a month right now, plus tax returns/bonuses until I've paid off the estimated $25,000. This isn't a terrible blow compared to the $1,200 a month he originally had me at before he took out my 401k contribution and yearly bonus. We're going to see if adding my live-in girlfriend's income/expenses will benefit me further, as I originally had us splitting every bill 50/50, but for the last 5 months I've been paying everything myself, except her mortgage payment (still 50/50), as her take-home income has become practically non-existent due to her own credit card bills, the extra deductions being made to her 401k (which she borrowed against twice to try paying off her credit cards), and a drop in overall pay, while my income has doubled.

    Now, on to my question; who will I list? My attorney hasn't asked me anything, but the paralegal mentioned the last time I was in that I had to update my creditors. I originally had 8 credit cards, but numerous collection agencies after that. I lost track of who I owed what to. It didn't help that a had multiple cards with the same handful of companies, with similar balances, but no account numbers on some of the settlement offers. It also doesn't help that the settlement offers practically dried up last year, and now I have no clue. I've being sued by 2, so I guess we know who they are, but I still need the other 6.

    It looks like the original 8 are still listed, in one form or another, on my credit report.

    List everybody and everything, down to the kitchen sink.

    List the original creditors and what you owe them, and list all of the collection agencies in order that they get notified as well.

    In a chapter 13, it is imperative that you list everyone that could be owed money in order that they get a chance to participate in your bankruptcy. Don't just depend on your credit report, do your homework and list everyone, regardless of how old the bill is.

      List them all. And ultimately you'll want to watch the claims register. If multiple file claims for the same debt, you can dispute it. Such as if the original creditor AND a collection agency file.

        Thanks.

        My lawyer is using my credit reports and a stack of old settlement offers, and he going to include everything.

        On the bright side, he said that with my girlfriends income/expenses, he's going to try for a Chapter 7. Her income/expenses is a drain on my income.
