    Finally filed today!!!!

    We met with the attorney this morning, went over paperwork. She was going to make some changes & file today. She checked to reaffirm everything, but said we will not be signing the house for sure, and if we don't want to reaffirm the cars after 341 then we just won't sign them either. She is still going to try and work a deal with Ally.

    The box "presumption of abuse" was checked, as we were a little over on the means test, but said "it's a math problem" and it should all be fine. As my husband has lost his stipend, she said it will be OK. She said that she felt we did not need to wait any longer (thank goodness). She also said there was only one trustee that she prefers not to work with, that most of the 19 of them are good to work with.

    Even though, I hate that we have filed, I am so very, very happy to have this started. She anticipates the 341 will be first week or so of August.

    I cannot express how much all the advice given to me directly and indirectly by searching and reading posts has helped through this process.

    My attorney filed for me and my wife today as well. I have already racked up 40 cents on Pacer! We were finally forced to file today due to our house being up for foreclosure next Tuesday (two years of no payments). We already have a place to go, but why not live rent free for a few more months? After two years of planning, this day is almost anti-climactic to us. I guess we can at least start answering unknown numbers on our phones again.

    Anyway...congratulations basketsbears and best of luck.

    I want to thank everyone who contributes to this forum as well. The plethora of topics and mostly helpful responses in this forum prepared us two years ago for this step today and now my wife and I are 100% comfortable with the process and our case.

    Only 90 days and some change to go...

      I am debating on whether I should get a pacer account or not. Where you able to see your filing?

      Congrats to you and your wife as well! I know what you mean on anticlimatic, but still just wanting it over.

          basketsbears, The entire sign-up process with Pacer was easy. You basically enter your name, address and credit card and in 10 minutes you get you log-on information. I did the query by my last name and our case was listed - make sure you have the right district. I clicked on several of the links that came up under our case number and then realized I was being charged for a few of the pages. The below link will take you to the Pacer guide that was posted on this forum. It will show you how to check for changes in your case and not get charged (if you want to see the changes, it will cost you). The guide says it is $.08 per page, but it is now $.10. The good news is that if you don't use $15 worth of pages in a three month period, they never charge your card. Something to keep in mind.

                I got my 341 date this afternoon...right in the middle of the first vacation I had planned in the last year and a half! Seriously...my wife's mom gave us her timeshare in Daytona from 7-21 to 7-28 this past January and of course the 341 date turned out being for 7/24. I guess there is something to say for karma, but really???? I know I waited until one month before my vacation to file (remember by hand was forced by my foreclosure), but I never thought my 341 would be only 28 days from when I filed...yaaaaay bk court efficiency! LOL. Oh well...

                  Congrats on moving forward. We had a pacer account throughout our process and it was great to follow along as things are filed and documents are issued. We were never charged as I read the pacer process here and all the tips for not getting charged etc. At the end our district only send out the discharge papers but the only evidence of the "case is closed" part was on pacer. It was an electronic filing of the closed portion so that is all I have. Had to print that part out for a couple of creditors that were not releasing the active bankruptcy from our account because they did not receive an actual closed file paper mailed to them. It worked and I was glad I had pacer. Good Luck!

                        Congrats to finally filing to both of you!! We filed on 5/29 and our 341 is not until 7/23. I am so ready to get that over with and move on!

                          I am relieved that we have filed, but still nervous because we are right on the edge of qualifying with Ch 7. My attorney had my husband sign an affidavit to declare that the income on means test is not a true income as he is not receiving $800+ monthly as he had been receiving. So nervously keeping fingers crossed....I think the expense/income looking forward we were maybe $100-300 short??????

                            We are in the same boat right on the edge. Was hoping to file this past week but could not due to hubby's overtime in Jan so will try again Aug 1st so overtime will not be included. Going to call insurance office Monday to get deductible changed tried yesterday but I was to late office closed. My thoughts are with you
