    How to go about making sure you haven't been sued without your knowledge?

    We are getting to the 8-9 month mark since we stopped paying on our credit cards and have been recieving many calls and letters from debt collectors (law firms and regular collection agencies). We haven't been personally served. HOWEVER since we are planning on filing BK, in the event that we are sued, I want to respond to the summons and buy some time and not recieve a judgement.

    I'm worried since no one is home alot, they might try to just print the summons in a small newspaper that I don't read Is there a website I could check periodically to see if we've been sued? Or do I have to go down to the courthouse? Also if we were to be sued, it would be within a court of our county of residence, am I correct?

    Most counties have their websites online - try searching for your counties clerk of circuit court....

      I'm not certain what is done in the area where you live, but they may be required to deliver you a summons. Maybe others from your state will chime in. I was sued a couple of times last year, and found out when notices were scotch taped to my door.

        It depends on the state. In my state, Louisiana, the defendant must be served in person. No person, no lawsuit.
