    My boyfriend is looking to file a Chapter 13, needs to file a chapter 7 but can't because he filed a 7 less than 8 years ago.

    We went and talked to a lawyer on Monday and he said that since we are living together that they will take my income and bills into account as well...no biggie.

    Could I file a chapter 7 after he files a chapter 13 and how will that affect either of our cases?

    We have a unique case according to the lawyer anyway because we are living together and have a baby together, but I also have 3 children from another marriage and we split custody 50/50 so no child support. Lawyer said he wasn't sure if a trustee would consider us a household of 3 or possibly 4 to account for the other children part time.

    This is so confusing and frustrating. Neither will have the $ to file until Feb anyway so I don't know what to do.
