To make the story short, i have a debt of about $23,000 on credit cards and personal loans and thinking about filing a chapter 7. I didn't want to go this route, but two weeks ago i got a DUI and now facing court, dmv fines and schooling. I wanted to get a lawyer to defend me and have the sentence put down to reckless driving instead, but it might not work since i dont have money to pay for that either. I make about $2,800 per month and take home only $893 after the rent, leased car, insurance and other bills. That doesn't include the $700 i have to pay for credit cards on a minimum payment. To sum everything up, i'm always on the negative side. Tried counseling on a debt consolidation and they can only offer me $535 per month for four years, which i would still be negative on my account. So, can i qualify on chapter 7 or the judge would send me to chapter 13 instead? I'm not really sure what to do as i am really confused. Can someone please help me and give me advice.
