    Collector called my sister 1500 miles away on her cell

    I need to vent. I have seen posts that stated answer the phone and others that stated don't answer the phone. I have to admit, I choose not to answer the phone except occasionally.

    Tuesday I was home during the day and decided to answer the phone. (This was because the mortgage company on my rental had starting calling my relative. They called while I was visiting my relative and they said oh, the phone is for you and handed me the phone). I noticed on this day I didn't get as many phone calls, my phone stopped ringing for a couple of hours.

    Today. My sister calls me and tells me that she just received a call on her cell phone from cc looking for me. They actually told her who they were and the amount of the debt. She asked me why I didn't just pay it off. It is one of my smaller debts, I actually have 2 different buz accts with the same company and had spoken to the other one on Tuesday. I don't know how they got my sisters cell number as she lives in another state and I've never lived with her.

    Today also my mother informed me that someone called her as well even though she told them I don't live there, they told her they would call her every morning.

    So needless to say, I called home checked my voicemail, set my cell phone to unavailable so that they couldn't get my cell number, went into a conference room and returned the phone call. The rep wanted to know if anyone was garnishing my wages... now why would I answer that question? So I didn't. She told me that would be there next step. I'm ok with that since they have to take me to court first and I will have filed bk by that time.

    When I got home, I answered the phone. But I only got two phone calls both regarding buz cc's. One from a hard to understand rep, probably who called my sister.

    So I guess, this is why I will answer the phone. I told the creditors, I didn't have the $ to pay and I was working on my finanicial situation. I'm over $100K in cc debt and planning to file by Sept, I really didn't want my family to know, but they know something now.

    Does anyone else have any horror stories about creditors calling your relatives on their cell phone?

    THey call my parents home all the time. Finally I went out and bought one of the boat horns. The next timed they called and I was at my folks house I took the phone and asked why they were calling them. He then began a long statement and that is when I let out the horn right next to the mouth piece of the phone. Man was that guy pissed. I told him he has MY number and if he calls this number again I will again do this and then report him to the proper authorities. No calls to that number since.....

      why don't you be proactive and send your creditors a letter stating they are only to contact YOU regarding your account and ONLY at YOUR phone number (not work).

          All of you must remember the name, address and phone number of your closest relative not living with you that you provided on your credit applications. If you miss payments, they will call them. Read all the fine print in the little brochures or the paperwork that came with your credit card/loan or when you applied. You will all be amazed at what you allowed them to do if you don't make your payments.

              Most, if not all, credit aps have have a spot for one to fill in the name, address, phone, etc. of the nearest/closest relative that does not live with you. You can list anyone you want but now the creditor has the name and contact information from you of a family member with your permission to contact them when you sign the paperwork. Many people just do not remember filling that out and it is almost always toward the end just prior to where you sign, and they wonder why that relative gets phone calls.

                  It is illegal for a debt collector to disclose that they are collecting a debt and the amount of the debt to anyone but the debtor. It is a violation of the Fair Debt Collection Practices Act and if you have them, your state debt collection laws.

                  What is the name of this debt collector?

                    I've never listed my sister as a reference on anything ever. Capital One is the name of the collecter.

                      The dirty little secret is that the origanal creditor is not bound by the FDCPA. The OC can be as dirty, mean spirited, nasty, rude, call whomever, whenever, tell whatever they feel like telling and there is nothing you can do about it.

                        Right but unless your state has laws that do not allow it, like Massachusetts.

                          The debt is now with an CA, "NCO Financial. There are horrible to deal with. I spoke with them on Tuesday, Friday and Saturday, (they called back Saturday a couple hours after talking to them). The collection person basically stated they would keep calling me every day until they receive payment. So, I told her I was sending a cease and desist letter to stop there harassing phone calls and calling my relatives, because I think they called my sister and another relative. This is a business debt.

                          Most of the other creditors have calmed down a bit since I started answering the phone.
