    Yet Another Question?

    I've tried searching thru all the Postings to find an answer for my question, but I'm not having any luck...So I'm hoping someone can help me!

    DH and I are working on filing a Chapter 13, maybe 7...not sure yet. Anyway's I totally spaced out that my Visa account has 2 names on in it, mine and my fathers..My dad never cosigned or signed anything I just got it for him back in 1991 because he didn't have a card at the time and was wanting one. Now he has never activated his card in all these years, he ended going with an AARP credit card, so I've only activated mine. I guess my question is if we file bankruptcy, can they come back on my dad for what I owe? Even tho' the account is technically only in my name? Account numbers are the same on both cards............

    PS - Reason being I haven't paid my bill in 3 months, per attorney. And VISA actually sent me my renewal cards today....geesh!

    It depends on how you set up the card. If you originally had him an an authorized user only, they can not come after him.

    If he is a joint card holder, then yes, they can come after him.

      Another Question?

      Thank you for your help, I am pretty sure that the afore mentioned Visa card was only as an extra card....I remember them asking me if I wanted one for any immediate "family" members...so I am thinking he's was just authorized to use the same account, which he never did.

        If he is just an authorized user, the account is not in his name and they cannot come after him; however, they do have his SS as the account shows up on his credit reports as him being an authorized user (if he actually is) and your credit could trash his. You should have had his name removed prior to all of this. If the account was joint, it would show as joint on both your credit reports.

          Hmmmm....I'll have to check my credit report. I am pretty sure that I never gave them my dad's social security number, cuz' it's not something he gives out lightly. I'll just have to dig a little deeper, thanks!
