    Question regarding spending $$ from car sale

    I have posted several times in regards to a possible bk in the next 6 months or so, I don't know why my atty is not answering my questions without a run around here! I owned 2 cars, one financed and one with equity, I sold the car with equity and after paying off the lien have around $10K left! IF I have yet to decide and file and all bills are current how can I be told that I spend the money that I could have trouble here? I did not know that pre planning bk was illegal and my atty said it has to be done in good faith, fine.

    Can someone give me some advice here, I feel like if I spend this money that I will be placed in jail. I have yet to file bk so what could happen if I were to take out $4-5k from my bank? How is the illegal, bills are paid.

    I love how the average US citizen is treated like a criminal for filing bk or asking what if questions however a large company can file bk and screw all of their employees and shareeholders of the company! Where is their goodfaith clause?? Help!!

    my understanding is that you can use the proceeds from selling that car on exempt expenses; put it into home repair, medical, pay priority debts (back taxes, child support, etc). that shouldn't cause any problems re: your future bk filing.

    ps i'm not an expert but this is my opinion.

      A stupid saying that an attorney I work with says, " You can keep the pig cute, you just can get the hog fat" (Say what?!). What this means is you can spend the money on necessary living expenses, such as, can't buy a new car, but you can put new tires and fix up the old one. You can replace the carpet in the house but you can't upgrade it to wood flooring. Stock up the fridge, just don't buy a new freezer, etc. You get the point.
