I will have to look up that number and call. She was anything but pleasant. If she calls my mothers house one more time I am going to go insane! Thanks for sharing your story!

Thanks for the info. I am hoping to pay 1/2 on Friday and the last half by the end of Sept. I guess I better start answering the phones and giving out the info.

Confused, if you can direct these callers to your atty, that is the best scenario.

But if in the meantime you get another threat to "fax papers to your husband's work" again, thank them for faxing you the evidence of their illegal collection activity on paper. Tell them that your husband is happily waiting for it, because he is not authorized to receive information on the account, nor are his coworkers, but they will all be happy to back you in court when you take legal action on it. Then add that, due to the rude tone you have experienced until now, you are now taping their calls. (You don't have to actually tape if you don't have the setup; just say that you are.) This usually results in some angry, blustering, "You can't do that!!!" statements followed by a quick hangup... but as far as they know, you got their threat on tape and are able to use it, which should minimize any efforts to actually send such a clearly illegal fax.

Then -- whether this is the original creditor or a collections agent -- you can send them a cease and desist letter, sent certified return receipt requested, that reaffirms that they have your correct phone number and address and demands that any further contact with you be in writing via U.S. Mail.

It would be *very* helpful if you knew your state's laws on this (the original creditor is not bound by the FDCPA, only third-party collectors are) because you could narrow it down even further depending on whether you were being harassed by the OC or a CA, but a plain cease and desist such as I have described should work very well in either scenario, if for whatever reason you can't refer them to your atty. Good luck!!!

Nolo Press book on filing Chapter 7, there are others too. (I have no affiliation with Nolo Press; just a happy customer.) Best wishes to you!

Thank you so much freshlikeadaisy!!! I had thought about saying that she records her calls and that she has on tape them giving her my account info. But I didn't since she really doesn't. I never heard back from my lawyer so I am going to call this morning and see what was done about the call. If nothing then I am going to do just as you stated. I even copied it down as I would say it to her. Thank you so much again.
Almost forgot, this was for a Children's Place card but since I was not paying it got handed over to a group called CTI. I also live in PA. No idea what our laws are here but I will ask at my appt. tomorrow.
