    My car leases and BK.

    Hi, im losing my job in about 2 weeks. I will have to file BK. I currently have 2 vehicle leases both end in 2009, one in aug, one in oct. If im in a ch13, i understand how much trouble it will be to get a car once i turn mine in after the lease is up, and im not quite sure i will qualify for a 7 because of my income, i would have to wait about 5 months after layoff to file to get be at the median income for a 7.

    Im able to trade the cars in a bit early, this could save me about $400-$500 a month if i got less expensive cars. But with trading in early, i would probably be rolling in about $4k per new car loan.

    My other option is to just buy the cars with no trade in, assuming my current good credit would allow it, and then stop paying on the expensive cars, let them go in the BK that i file in a few months. This option would likely save me $600 a month in car payments.

    What do you all think? Whats been your experience? Thanks for your answers!

    I would buy the "new" cars now, and then turn the lease vehicles in. I would not use them as trade-in because of the negative equity.

      Before we filed, we stopped paying our lease and bought a replacement car.

      We let the lease car go in the BK.
      Chapter 7 Filed - 11/27/07
      Discharged - 2/29/08
      Unsecured Debt Discharged - $162k +/- (small business, personally guaranteed)
      Finally Closed - 3/1/09

        So you think any red flags if i buy the new cars and wait about 4 months to file? Im thinking one payment will go from $700/m to $350/m and the other will go from $600/m to $350/m.

          Reliable and affordable transportation is a necessity. What you're proposing is not unusual.

            DO NOT TRADE!! If you can, just either buy or lease different cars and give those back!

              ok, asked this on another topic, but i think it got ignored in larger issues - but this one is a big concern for me

              filing bk7 this week
              lease for truck is an exemoption on the filing, but due to turn back into dealer in november - its the only car my family of 4 has - I am also financing a motorcyle, that is also exempted

              what do you think my options will be in november with the car dealer? I am current on paying with them, likely that they will still work with me or no chance at all?
