    Mortgage company oddness

    So a couple of weeks ago I called my mortgage company to see how they handled ride-throughs in the event of Chapter 7 (specifically stated that I had not nor was I planning on filing at that time).

    Low and behold, today I get this letter asking me to confirm my contact information, such as home phone #, work phone, etc. and address. The letter specifically said that my account was recently updated. I called to find out who updated my account, and according to them, they spoke with my wife, which is completely BS, they never spoke with anyone in my family. Is this is a coincidence, or did they put some note on my account about my inquiry on the ride-through?

    I'm probably being paranoid, but....:-)

    I can't venture to say what exactly was noted, but yeah, it sounds to me as though your acct has been flagged either in anticipation of collections activity OR sent on to their version of a "legal" department in anticipation of bk and possible foreclosure. (It's still technically foreclosure if you give it back to the bank in a bk.)

    However, I wouldn't worry about it. It should not change the way you've been doing business with them if your loan is current at this time, and it won't matter in any practical sense even if/when you file Ch7. They will still have to jump through all the hoops they were going to have to jump anyway.

    Just for curiosity, did you note the date it was sent to you? I would want to know whether that letter predated my call or is a direct result of my call.

    Like the song says, paranoia will destroy ya... so don't worry too much about it.

      The date on the letter is a few days after I made the call

      I actually called them back last night (for a 2nd time) and asked again who updated my account, and I was told it was the collection dept who updated my home phone (which is possible because I believe they did ask me for my phone # when I made the original call to their BK dept). According to them, they did not have my home phone information at the time I called. They offered to put through to collections again so that I could ask them not to make any more changes to my contact info. She also said no other notes were added to my account

      When we file Ch 7 I am planning on doing a ride-through so I am hoping this doesn't have any affect. I have never been late and don't plan on being late

          Yes, that's exactly right, Teddy. You keep making payments but don't sign any reaffirmation agreements, and both the lender and debtor go on as before the bk. Technically, it's no longer legal under the new law, but many lenders and debtors are still successfully doing it, so... if it works for you, great.
