    Wish us luck...I am very nervous. I am afraid I am going to choke if asked how we got to this financial position. Basically I've ben asleep at the switch and spendding way beyond our means. Made decisions based on a promised salary increase that did not happen.

    DHA,
    I'm not there yet, but I can feel your fear. I'll likely have the same .... One note of possible encouragement: It is my impression even as a newcomer to these boards that you don't have to justify the debt--only perhaps certain huge last-minute "luxury" purchases .... or large cash advances ....
    Bankruptcy isn't "judgmental" in that sense. As long as we don't commit the "fraud" (legal definition), I think we're ok.

      Good Luck Debt...remember less is more. Very short answers seems to be what I am hearing here. Mine is in a few weeks...I'm sure I will be just as nervous.

        Good luck. I PROMISE PROMISE PROMISE it will be nowhere as bad as you think. And chances are you will not even be asked "how you got in this mess."

        Most people say the 341 is short and very simple. You will leave there and feel like cracking open a bottle of champagne. Trust me.

              The simple fact is: it does not matter how you got into unmanageable debt. Unless, of course, you are deliberately "gaming the system". Then, you would have to be pretty darned clever to avoid detection. The October 2005 code revisions have made it very difficult to escape responsibility entirely.

              You see people using credit cards to purchase their morning coffee, for heaven's sake. What does that tell you? A lot..but that's really another story...

                You will be fine - just respond to YES - NO to 90% of the questions and it will be ok.
                As always dont give more info than what they are asking.

                      Update: it went pretty good. It was quick. The IRS was there and asked if we had a active audit both of us said no. Then they asked if we had a business. At first we said no, but then I said yes, that we had a nuritional product internet based business in 2005 & 2006 that was a pure loss. Not sure why the IRS was grilling us. The trustee's representative was pretty cool. There was a mistake on the mean test that the attorney needs to fix. Then the trustee said we don't meet the plan and I about pooped myself I was so nervous. Then he pulled it up and said from what I see you meet the plan. Then he said the meeting was conducted and excused us.

                      Now I wait for the confirmation hearing.

                            I believe the IRS is at all 341's. They had a list of names on a piece of paper of all the cases on the docket for the day.

                              Even if you don't owe tham any money? That seems strange to me
