    Fair enough, you did mention it, but it still wasn't clear that you meant, you were receiving statements NOW. From the context, it seemed like you were saying, it was a few months later after receiving the payments (5 years ago) that you received the statement that made you conclude the payment was an error.

    Ok, so if CSRS is STILL sending you statements that say you owe the money, you need to list it on your BK.

    To the heart of your question, can this debt be discharged? Gut instinct, is NO. The money they sent you was not intended to be an extension of credit.

      I would say that it may be similar to unemployment. My brother included an overpayment of umemployment on his bk and it was discharged. Of course I can't be sure of whether this would be the case, but it does seem like similar situations. They stopped sending him statements when he filed. He filed a 13. They didn't file a claim and zeroed out the account. Can't hurt to list them and see what happens.
