Between Filing and 341

    Between Filing and 341

    I am a bit of a control freak. And it is really bothering me that I do not know what is going on with my case right now. I filed on 6/29 and our 341 is on 8/1. So, what is happening with out case right now. Is it just sitting there waiting for the 341? Is there any work being done on it for some reason?

    Any ideas?

      Basically - yea it is just sitting there. Notices went out to all of your creditors. They have the option of being present at the 341, though it is rare for them to show. However the time period between filing and the 341 allows them to recieve their notice and plan to attend if they so choose (once again that is rare). In our case the trustee reviewed our case before the 341 and came up with any additional questions she would want to ask at the meeting.

        What kinds of questions did she ask you?

          She asked the standard questions - Did you list all your assets?, Have you transfered any property?, Any payments over $600?, ect. ect.
          In our case she also asked for further explination for our daycare expenses as we use our dependent daycare account to max. 5000 and the rest is out of our net pay so it was listed in two seperate places on the form. She just wanted to make sure we hadn't listed it twice. Our petition had a few minor errors and she asked us to correct those (for example we forgot to check the box saying we had life insurnce, and we accidentally left our kids off of one place they needed to be listed).
          We were done and out of there in no time flat. Our lawyer was actually emailed the additional questions she would ask us several weeks before the meeting so were already aware of the mistakes. Though, I haven't heard of any other districts doing that.
