    Just got back from our 341!

    Oh my, what a day!

    Well, my apologies up front for the lengthy post, but here's the blow-by-blow:

    We got to the meeting place abotu 25 minutes early and sat and listened to probably 10 cases prior to ours. We didn't know it yet, but ours was the very last case.

    As debtor after debtor went before the trustee ahead of us, I got more and more nervous. This trustee wasn't just asking a few questions and there were a lot of "I'm continuing this case for...." from him. Ever single case ahead of us had an attorney... so we were the only pro-se filers that were there.

    When he asked the "why did you file" question to everyone... there were a lot of "divorce", "illness" and "job loss" answers... in fact, we were the only ones who's answer WASN'T one of these.

    Finally we get up there... He asks his questions... None of which were tough. He didn't even blink on my explanation of why we filed.. "my job moved, we had to finish a remodel before we moved and then expenses in the new state were a lot higher than we expected."

    He never even asked us about our income or expenses, he never questioned any of our exemptions... contrary to what that ******* attorney we were working with said, he didn't even ask about the cafeteria plan "income" on my paycheck stubs.

    He then says, "Normally I'd ask you for some statement history due to the large amount of unsecured debt, but I see that you have already provided a substantial amount of information to the US trustee and he has informed me that he is satisfied, so, thank you, have a nice day, you should receive your discharge in about 60 days."

    Can you believe it? After that ******* attorney was telling us that we'd have very little chance of getting a chapter 7 and then it would only be if we fought tooth and nail... we breeze through it with no problems.

    This went better than my wildest dreams. I figured we'd AT LEAST have to wait for the 60 days to find out if the US trustee was satisfied or if they were going to object... but nope. We're done. All we have to do is wait the 60 days and collect our discharge.

    I'm really hoping that our case shows some of you out there that you CAN do this, you CAN do it yourself and, most importantly, that you can NOT rely on your attorney to "do it right". It is very much in your best interest to do your own research, make sure that what your attorney is saying matches up with what your research is telling you or that you know WHY it is different.

    If we had listened to our attorney, we'd be out yet another $1000 in attorney fees and we'd be waiting for confirmation of a Chapter 13 plan that we couldn't afford.

    Instead, we're kicking back, waiting for the discharge!

    Thank you everyone for the fantastic help and information. I really do not think that we would have had as easy of a time of it if we had not had this forum to help us.

    Now, I have to catch a plane to Dallas for a training class for work... but beliee me, I'll be on here lots in the coming days and weeks... just in a LOT better mood than I have been in the PAST days and weeks!

    Glad you meeting went so well............. now its sit back and wait too see if any creditors object........ hopefully they won't............ If the US trustee didn't, then your looking fairly good.....

    But ya never now what will happen, so sit back, have a cold one, and wait out the 60 days till discharge.....

    Keep us posted as to what's going on and chat a while with us while you wait....

      Considering we haven't touched a credit card in over a year before we filed... I'm not too worried about creditors.

        I am so glad for you that everything went well at your 341!!

        Sounds like the UST's office has been in contact with the Standing Trustee and you'll be good to go after your 60 days is up!!

          Hearing the trustee tell us that the US trustee had told him that he was "satisfied" was probably the happiest moment of the whole thing. I mean... it was nice to hear the regular trustee tell us that HE was done... but to have him tell us that the US trustee wasn't going to object on anything either?

                Im very happy for you!!! Big thumbs up! Did you go to *C* city courthouse or *T*? I heard a trustee at *T* was harder, but who knows/. I wonder what I should answer when they ask WHY?

                  So glad to hear that it went so well Lostone. We went pro se as well and while ours didn't go as smooth as yours it has still been going well. Congrats, welcome to the 60 day club. Hopefully you won't have any objections and 60 days will pass very quickly.

                    Am I correct in assuming if you make it to your 341 without any US Trustee objections you are good to go barring something happening at the 341?

                    We went through our meeting about a month ago, Pacer shows everything is moving along with no objections so I'd assume we're good to go?

                      It's a total of 60 days after your 341 for objections. Hang in there. You're almost done. BTW, be careful how many times you browse your documents on PACER. Even though it's only an .08 charge, it can add up to $10 before you know it......you don't pay for PACER until you go over that $10 mark. Best advise here, always check the last date if filing. If that hasn't changed, then all is well.

                        I've been pulling the page that lists all documents/history? That seems to give the totality of the situation listed oldest to newest. Is that the best page to be looking?

                        $10 is cheap if I still have all the hair on my head! Filing didn't bother me, the 341 didn't bother me, waiting is killing me!

                          You don't even have to go as far as reviewing your history/documents. When your enter your case number, and your info comes up, just look at the top. This is where it lists your name, date filed, and etc. That's where you need to see if the last date of filing had changed. If something was filed recently, then you can go to the documents/history and see what was filed.

                            We live in Salem county and so we went to the Camden court... although the 341 was held in different offices down the street. This trustee was more thorough than what we've seen people post on here... but he didn't seem to be "digging" for a reason to object. It really did seem like he was just trying to be conscientious about his job and make sure everything was done properly.

                            Here's something you probably don't hear very often: We were the last case to be heard and after we were done we chatted for probably about 10-15 minutes with the trustee and his assistant about various non-bk related topics... weather, the differences in the climate in NJ vs UT vs WA etc. etc. Maybe we got the only human trustee in the country... but he really seemed like a decent, nice guy.
