Bayview Loan Servicing has posted the required notices and had scheduled our home to be sold at auction on 6/28/12. However, yesterday Oscar from Bayview called and said that they postponed the sale and that they wanted more documentation from us and could maybe work out a DIL or shortsale. The house is listed with a realtor. The docs they want are: last 2 years of all 1040 tax returns, full bank statements for all accounts for last 2 mo., including 401's and ira's, hardship letter (husband is unemployed over 2 years now), last 30 days of my pay stubs (I work part time), SS statement, signed 4506-T, completed Uniform Borrower Assistance Form. We submitted all these forms to them in January and now they say they lost them but that they could help us if we resubmit. Is this the normal procedure? To wait until the final hour and then expect us to jump thru hoops to supply them with all the info they ask for? Does anyone know if this is how it works or are they just wanted more info so they can sue us later? We are in Tennessee which is a deficientcy state. And, also what happens if there are no bidders at the auction who wants this house. What happens if it doesn't sale at auction? Has that ever happened to anyone?
We have allready moved out of the house and realize that we can't and don't want to afford it. We had told the lender that we would be willing to do a DIL back in January when we first submitted forms to Bayview. They don't answer their phones and don't return calls. They only call you when they think you are in a panic.
Has any one else had dealings with Bayview? I would appreciate any info. thank you
