    Being sued for HELOC

    My question involves a mortgage in the state of: Wisconsin

    We have been foreclosed on our 1st mortgage and are currently in the 6 month redemption period. We have a HELOC for approx 8k and the holder is suing us in small claims court for that amount. They have stated that they are going to attempt to garnish our wages. We are planning to file chapter 7 but we have to wait to file until March of 2012 due to some money we paid back to our in laws.

    My question is is there any way we can delay the garnishments or the judgement? We owe the money so the only thing I can think of is to try and stall as much as possible.

    You should easily be able to delay until march. Answer the suit (obviously) then do discovery, etc...that will eat up a few months alone. They can't garnish until they win SJ anyway. Have to check with others on Wisconsin State laws, timelines, and possibly that small claims court works different... my understanding has always been Wisconsin is a VERY friendly debtor State with their consumer laws.
