Tennessee foreclosure
I was wondering if anyone had any experience in the Tennessee area with foreclosure. We got our letter yesterday that our home will be sold at auction August 10. We were discharged June 23rd from our chapter 7. When we filed we told our attorney we would like to keep our house if we could do a loan modification. We applied for HAMP, but they wouldn,t do anything until GMAC got it out of the bankruptcy which was only a few days before our BK was discharged. A few days after discharge we received a letter from their attorneys for NOD. Then yesterday received a notice of sale. I contacted GMAC after we were discharged to check on the loan modification and was told we had to refill out all the paperwork since it is discharged from BK now. In the meantime, I made an appointment for this coming Thursday with a counselor to see if we qualify for the new government program since I did lose my job. She told me not to send in HAMP paperwork until we meet with her. We live in the middle TN area, and I know all states are different. Does anyone know if they will offer us the cash for keys after the sale on August 10th, or if the sheriff will knock on our door and set our stuff out. Any help appreciated. Also , from talking to the counselor abour the new government program, I am not sure we are going to qualify for the new program, because we were in a chapter 13 before I lost my job in November, and converted to a chapter 7 once I lost my job. She stated if you were already behind before the job loss, she didn,t know if we would qualify. I told her we weren't behind and that our payments were included in the 13 payment plan. No payments were missed until I lost my job in November and we converted to a chapter 7.
