    Questions about NOS timeline???

    We received a NOD notice on Aug 4th. In reviewing the time lines I am still confused on how long I have. I live in CA and went to our state website which stated a NOD would be filed then after the 3 month reinstatement or cure period the lender can then file for a NOS.

    So my questions are:
    -3 moths from what...The last payment or from the date of the NOD?
    -It also does not say what is the typical time frame for NOS to the actual sale date. Some people have told me that they have to give you at least 3 weeks from the date they notify you before the sale date. Can anyone confirm?

    In order to live rent free for as long as possible we do not want to move until we receive the NOS but I am all upside on the time lines and need to know if we need to move now.

    Here are my stats:
    Ch7 Discharged - 01/09' mortgage IIB
    Last Mortgage Payment - 02/10'
    NOD - first week of 08/10'
    Upside down on mortgage about $90K

    Usually, it's 90 days from receipt of NOD. They then can issue a NTS. My NOD (Southern California-Bank of America) was issued 11/09. NTS received 02/10, house sold back to bank on 03/18/10. Banks are starting to pick up the pace here in California..Bank then resold to private buyer 07/03/10..In my case, I'm glad it's over with. Good luck.

      Thanks for the input. I also want to get this over with soon then later but I am hoping for a little later to save up some cash to pay for school.

        In my case my sale date can only be posted after 8/28 [according to the NOD paperwork] So I will still have a few weeks after sale date? Trying to find a rental and don't know if I should get something the beginning of Sept. or can stay till Oct.

          Hi ! Things really suck in Stockton still, I see..Banks are getting more aggressive. Just my opinion but the earlier the better. Things still totally blow here in the High Desert...
