Ex (never married) and I co-own a home. Because of his unwillingness to cooperate with signing a quit claim deed, I just got served with foreclosure papers.
The foreclosure paperwork was delivered by a sheriff, and the 1st and 2nd's notes are attached. However, the mortgage notes both say the we are "married," which has never been the case.
As far as building a defense against the foreclosure, does this incorrect marital status come into play at all?
