I have been attempting to apply for a Loan Mod with BofA/Countrywide since Feb/09. I got the same runaround story everyone got, must be 60 days late, etc. etc. Then was told that my investor was not with Fannie/Freddie Mac and didn't qualify for a loan Mod. I continued fighting and calling to no avail.
Once countrywide sold to BofA I was no longer able to get information on our loan, seems like all of a sudden, BofA does not have the correct SS# for my husband on their file. When we try to get information they say we can't verify what they have and therefore can't give us information on our loan. We joined a group of members on behalf of loansafe (another awesome forum) that emailed a Phoenix TV station reporter who was doing a report on the lack of response Bank Of America had with their mortgage holders. Within 2 days we got a response from the Office of the President. We were assured we'd be helped, etc. etc. We submitted our financials over the phone twice. Faxed them in twice and then Overnighted them via FEDEX on two seperate occasions only to get a letter a few weeks later from the OOP saying that after numerous attempts to reach us and request for documentation from us to no avail, they were rejecting our request for a loan mod!!!
I am emotionally drained. I refuse to go the short sale route with BofA and I'm tired of fighting against a brick wall. I am scared but not as attached to the home as I was when we first started this process. I'm contemplating just riding it out until the Foreclosure comes through. We recieved the NOD in October/09. Not sure how much longer it's going to be as I answered our Lis Pendens to the courts that we were attempting a Loan Mod and also sent a copy of that letter to the banks attorneys.
Now I'm wondering, should I file for BK to protect me against any deficiency. I have about 5k in debt and some medical bills, not more than 5k for medical. Our debt isn't very big, it's the house and it's deficiency that scares the WITS out of us! Is it worth going the bk route if you don't know about the outcome of the deficiency, or just better to ride out the foreclosure? I know I qualify for Ch 7. Our income is not high at all!
I'd love to hear everyone's thoughts please. So many of you have so much experience in this subject that you might be able to help shed light on this situation.
I'll give you some Financial Statistics for further background;
- House Loan 210k (original loan 139k then refinanced and cashed out about 50k to pay down CC's and our car off etc. 210k represents the new loan amount but it's only one loan and we have a 7.75% interest rate/FHA loan.)
- Value now: 140k (on a good day) (60k underwater)
- Payment $1900/mo on a 50k a year income with 3 kids.
We simply got tired of robbing Peter to Pay Paul every single month. Our stress level was beyond what I can explain just to pay the mortgage. Our mortgage payment represented close to 70% of our take home income every month.
