    Pretty sure someone tried to serve us tonight...

    I took the kids to their back to school night and came home to find a sticky note on the door. Handwritten, saying there was a delivery for Mr. "dh's name" and to call such and such number.

    FedEx and USPS don't leave handwritten yellow sticky notes.

    Good thing I meet with the attorney on Tues.

    We are putting the retainer, but I was hoping we had another 2 months to tie up some loose ends and get things in "order".

      Even if you get served you are a long way from judgment. You have plenty of time.

          The attorney did say it could be as little as 50 days from the day we were served. *Ideally*, I'd like to be able to file at the being of November. Which would give us just over 2 months. I guess it's *possible* to stretch it that long.

          We're in TX, so they can't garnish. However, dh gets direct deposit for his VA disability and his paycheck. I'd hate to have those nabbed.

          Which leads me to a question I was going to ask the attorney on Tues...but maybe someone here know...if they do levy a bank account, do they get a "one time" grab, or can they keep coming back and grabbing every time you get paid or money goes in there?

            If you file an answer to the suit, you get even longer. I was served in Nov 2007, Feb 2008 and Nov 2008. None of them had seen the courthouse when I filed in Dec 2008.

              I think I'll ask the attorney about that on Tues.

              Does anyone know if their fees cover that? (I suppose I'll have to ask him that, but figure someone may know)

              We're paying quite a bit for this attorney...compared to what I see a lot of people paying for a Ch7. ($2800)

                No the attorney will definitely charge extra to defend lawsuits.

                In some (many) states there is a filing fee for an answer.

                Mostly you can ignore the lawsuits. The absolute quickest I have seen them move from complaint to a garnishment order was here in NJ, 35 days time allowed to answer, automatic default is granted to plaintiff, then a few days later we got the motion for a wage garnishment order, so we then filed.
