    falling off the matrix

    About 6 months ago I let a close friend move in that has been having a lot of bad luck in life.

    he lost his job and had a very bad illness that put him in a bad way.

    Anyway when he moved in with me he had a lot of debt, medical, credit card you name it.

    He was about to be seriously harassed by a lot of folks looking for money and I doubted if he could handle it physically.

    Anyway I suggested he change his address from where he lived before to an address in the south, found in phone book, I got him a cell phone on my account, and to not use any form of credit for the time being.

    I am helping him file bankruptcy soon and just for the record no one has called or even knows where he is.

    A funny thing is we pulled a credit report to help fill out the bankruptcy paperwork and that address was on all his reports with a zillion inquires.

    I have to say he is getting a lot better and not having to deal with collectors has been a real blessing.

    What I did maybe was not right but what those slimy credit collectors would have done was a lot worse.

    I am just curious how successful others have been in falling off the matrix?

    I will be relocating out of state and staying with the folks for a few months. Going to set up a PO Box to forward mail locally and have my friend check on it once a week for about a year and than pull the plug with out a forwarding address. Collection letters have dropped off a lot since I do not respond to them and do not answer the phone since the ringer is off.

    In no rush to file BK until my situation changes.

      I've had little problems but most of my non-government debts were wiped out in my C7 BK in 2003. You might consider using google voice for a phone number (hint: you can get the number in any state). It will allow you to screen calls and have all calls from the collectors either blocked or sent straight to voicemail.

      For what it's worth the few non-government debts I have are all about to go off my state's statute of limitations. In addition I am almost (next year) eligible to file Bankruptcy again if I must. I'd say it hasn't been very hard for me but then again I show as having no assets, priority creditors (the government), and income below poverty levels. I'm not a prime target for collection.

        I take it you owe back taxes? Can you discharge federal and state income taxes in a BK if they are three years old?

          A majority of them. Most of the taxes are penalties and interest incurred from taxes I had prior to the BK in 2003 (when my income was 5 times what it is now). I mistakenly thought taxes were NEVER dischargeable then and wasn't aware that had I of waited another year before filing BK I could have discharged them.

          I have to wait until at least July 2011 to declare BK again if I do that.

          The government has a lien on me so I think most creditors have figured out that the government always gets first priority not them so judgments will do them little good.

            So you can discharge 100% of three year plus federal and state income tax debt outstanding?

              Yes, I should be able to. But there are different rules and stipulations about it. For instance I believe you must have filed the tax return over two years ago and I believe the tax must have been first due at least three years ago.

              In my case they will still have the lien unless I find a way to get rid of it. The lien is from 2004.
