    First collection letter ---From NCO Financial.

    So after 3+ months of not paying bills we got our first collections letter from NCO Financial for AMEX.

    First question I have has anyone dealt with them before? How were they?


    Also should I send a DV letter on the first letter? Should I ingore them? Wait till late June to send the DV letter?


    The main text of the letter...

    Unless you notify this office within 30days of receiving this notice that you dispute the validity of the debt or any portion thereof, this office will assume this debt is valid. If you notify this office in writing within 30 days from receiving this notice, this office will obtain verification of the debt or obtain a copy of a judgement and mail you a copy of such judgement or verification. if you request this office in writin within 30 days of receiving this notice, this office will provide you with the name and address of the orginal creditor, if different from the current creditor.


    We are planning on filing Chap7 within the next few months. Basically I got another state funded extension of unemployment that we weren't expecting. But with a child due early November we might try and hold off till then also.

    Any help would be appreciated.

    Dispute the validity by certified mail (return receipt) a couple of days before the deadline.

    Even if they took you to the court in ASAP (not very likely) you could still get where you need to be time wise IMHO.

      Ahh yes, NCO..............send them a DV, and they will go to sleep.

          If memory serves, it took a few days after they received my DV for them to stop that loud obnoxious recorded message to stop, but one it did, not another peep from them.......but since your dealing with AMEX, be prepared for them to sue

            Yeah just hoping that the lawsuit comes after August. That way we can delay it enough for chap 7.

              yeh, I just started getting calls from them....what is with that idiotic message??? can't imagine anyone would respond to that!

                I have also received this letter and here is the part of it that concerns me:
                "or obtain a copy of a judgement".

                What does that mean? Does it mean if they choose to do so, they will just skip the verification process and go right for a judgement?

                  If they have not sued you, and won in court, they don't have a judgment. What they are saying is that if there happens to be a judgment on file they will get it. Otherwise they will get other stuff to validate the debt.

                  Looks like boilerplate that they just send to everyone and covers all contingencies.
                  First consult: You go now, no CH 7 for you. You spent entire buffet. 13 has a 95 percent payback. (Owwwch) On to next consult....

                      Don't get jumpy, it takes a while to sue, get a judgment and get a garnishment. ;-)
