Received a debt settlement offer from Zakheim & Associates, a law office, on behalf of Discover.
They are offering a settlement of $5300. I have until and underlined in bold text December 18, 2009, to make a check payable to Discover and it should be received, again in bold and underlinted by December 18, 2009.
I don't have anywhere near $5300. Have no intention of same.
I'm also not in a position to file BK, at this point. I have been trying to "work with" creditors, and unfortunately have not yet gotten to who ever it has been til now that has been representing DIscover. Obviously now, it has been moved to a law firm.
Interestingly enough, the very same law firm that did file a summons and w/intention to sue me on behalf of Target. I did call said law firm, to avoid suit, and work out a payment plan with the Target acct. they intended to sue on.
Why haven't I called to work out a payment plan with Discover? Well because I am just tapped out. Why don't I file BK? Because I may try for a mortgage mod, but as of yet haven't even started that ball rolling, because I make too much (the mtg payment is not more than 30% of our income). It's just that we are, seemingly, making decent money. But it takes everything and then some to stay ahead of all the CA's after me.
So what should be the course of action at this point? I want to stall for a while longer, if possible, and not be sued for the debt. I would like to, if possible get into a payment arrangement, but as of yet, I am not in a position to do so. So I want to stall, and then, at some point, yea maybe go ahead and either file BK, or make payment arrangements.
