    How long before being used by CC Cos?

    I am just over a month late on CC payments and like to know how long (months) before being sued for planning purpose. Does anybody have any experience?

      May I ask about how much you owe, any big amounts to a creditor?? We stopped paying in July of this year. Tons of calls, threatening letters but so far so suits. We are probably doing the 13 route, just waiting for a bit.

        I think the highest we owe to any one creditor is like 21k to BoA.

        Our calls have all slowed down. I hardly get any now. Still getting letters with negotiation payoffs though.

        Our total owed is around 85k.

          Thanks. We owe around 30K, but I am sure it has gone up since defaulting.

            I owed about 35K, 20K to Chase. That's why they are the ones calling 8 times a day. I'd like to file in June nest year but may have to hurry if got sued to avoid wage granishment.

              I owe 20k & 6k to Chase, 30k to Citi. Stopped paying in April, this year. Lovely morning out by my car today where I was met by the nice process server for Chase. Guess I better step up the game! So just over 6 months for me with Chase, not a peep out if Citi for the last two months.

                Chase has been the quietest of mine and i stopped payments about the time you did. I assume your in Ca, so with Citi, prepare to be sued by Hunt and Henriques.

                  Stopped making payments one year ago last month (December). I very rarely get calls or letters, and even though the phone number they all have on file is one that I let go you'd think they would be able to find my home number easily. I told them all mid-year 2009 that I was no longer working, plus I retained my attorney in May and gave them all that number. I'm sure they're all wondering why I haven't filed yet, but maybe that is holding them off. Plus our home is only in my husband's name so it doesn't show up on my credit report. My car note is on there, but I was over thirty days late on it recently so it will show that I'm slipping there as well even though I'm planning on keeping it.

                  I had/have around seven or eight accounts...all the big ones (Chase, Discover, Citi, Capital One, Amex) with a total of around $80K.

                  I'm hoping to file very soon because I feel like I'm pushing my luck. Has anyone gone more than a year? Is that fairly common?

                    I went 6 months with no threats of suits before I filed. The phone calls had slowed down and we were getting a lot of settlement offers.

                      Quite common to go longer than a year.

                      We went 2 years before suits. After year 3, we had one that was getting serious, and could have been a real hassle, so we filed.

                      You can drag it out even further by filing a simple answer to any suits that do occur. A one-page response and denial can add many months of time. You can see the documents with a quick search online. Then customize it to fit your case and file it at the court. Or if you can afford, have an attorney do so.

                      We filed one answer, in one case, and never heard from the opposing law office again. The case was eventually dismissed without prejudice, but never refiled. We ended up filing CH 7 last month, so it is moot now, but was helpful back then.

                        For me its over a year now, several different major creditors, some even send them off to local attorneys here in my city, but they still dont sue.

                        If they did sue, by the time they got a default judgement and writ of garnishment, another 6 months would go by because they are so backed up.

                        So I am waiting it out, but I want this over with, so I will file within a couple more months, so I can get on with my life.

                          WOW! I missed my first cc payments December 21 and have now missed payments on all 10 ccs, amounts of $3000-$7000. I want to wait till end of March or beginning of April to file. I cant imagine riding this this out a year or longer! So far, Discover is the only calls I am getting.

                            I am wondering if they will sue if you provide to them before hand that you are collection proof. Seem's then to be just a waste of time and money.
