Seriously, about how long can I hold them off.....

Looks like my filing date is going to be pushed back till maybe november or december.

Missed my first ever payment and going to miss another account payment soon.

I plan on paying on 2 small, accounts the minimums for awhile. The 2 larger accounts total around $50,000, damn hurts to even type that....

I had some unforseen things come up and I need about a $1000 to get them took care of, so the money I was going to pay my attorney is going towards this instead.
I have allready called my attorney and explained to him what happened, he was OK with delaying my filing a month or two.

If I just have to I have 2 other items I could sell to get a few $$$$ together, but I dont want to if I can avoid it, since I have allready sold off most of my assests to pay these debts down.

So how long should I have before the 2 accounts I am defaulting on start to get pissy, I think I can stall for a month before things get heated, so to speak.

I would advise you not to pay the other cards as well. You probably would not be looked at as preferential, but you could. It will not help you anyway and what's another phone call over keeping a buck? Credit will be toast anyway for a while. 'Hub

Oh yes, about 30 days or just a tad sooner for "reminder" calls.
If I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.

I had to tap one the other day for part of the funds to pay this $1000, so I plan on making a few months payments, then add it to the list.

As of now everything has been cut and shredded....

What the heck, stop paying everyone! If you are not filing until November or December, why do you care? Today is August 17th. While you could potentially get sued, you would have another 45 - 90 days to deal with this. Any judgment or lawsuit can be put to rest under a BK 7 or 13.

If you think that missing a "payment or two" is going to rush creditors to suit, then you are probably wrong.

When I spoke to my legal counsel over two years ago, he told me there was nothing to be gained by paying anyone anything. If I would have declared a BK 13, he said, "We can let the trustee work out the details." Unless you are attempting to hide something form the attorney, I doubt you have anything beyond the 90 day rule to worry about.

            Just my OPINION.

I agree with TH here. Don't piss anymore money away paying those cards, believe me, they won't thank you or blow kisses your way for doing so, and they will get just as pissy if you stop paying tomorrow as next month.

It's funny, my wife's Amex (optima) card has "member since 81" on it, and you know what? Missed a payment and they told us "you account is now closed". As a consumer you need to be as ruthless as they are.
filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

Amex canceled my card at about 80 days. I'm approaching charge off from citi, bofa and discover. The odd thing is the calls have nearly stopped, calm before the storm?

Maybe I misunderstood, but you need to be at least 90 days out, so I thought I would make a few min payments till then, I know I cant pay them off.

We stopped paying most of our Credit Cards at the end of last Sept. Our accounts have gone a traveling LOL! from one collection agency to another collection.

Talked to the credit cards at the beginning and gave out too much information as I told them we would be filing in Jan. 09. Then found out from this Forum some monies I was receiving would be deemed Income. It dropped off this past Feb. They started calling back end of Feb/early March. Was dx with Skin cancer so answered their phone calls & told them we would not be filing until I received full clearance on the cancer issue. At the advise of our Attorney, since we had already spoken to the CCs twice, he suggested we not answer the phone unless we knew who was calling.

Have received the normal form letters from the Collection Agencies and two form letters from Large Attorney firms who are not licensed to do business in our State.

One more week and I think we've got it made as we are filing Chapter 7 on 9/30/09 based on March - August income. Don't believe there would be time for a Court case now.

I tried the 'pay what I can approach' for a couple of months... now after a job 'opportunity' that evaporated in a month and a half, I'm jobless, out of unemployment benefits, and still have to eat and keep the lights and water on. It sounds logical to pay the little ones, but in the end, it really doesn't matter. Once your credit report takes a few hits, they will ALL get impatient with you and cancel or drastically change the terms of those little cards you tried to pay.

I have thought about canceling the 2 smaller cards, I figure it is like you say, only a matter of time till they close them anyway.
