krispy 12, aparently you are not familiar with people who have/had worked for the government. Some have certain security clearances and in some cases, do get followed. I suspect a lot don't even know they are being followed.

As for 'No Trespassing' signs, when the repo man came and was trying to repo are car, he went and looked to see what I had covered up with tarps. If I had the signs up, I could have gotten him for trespassing.

I had my car for a year after I was informed it was up to be repo'd. I moved a few times, unrelated. A couple weeks ago I saw a truck out front of my house after dark. A plain old crappy truck. I guess they followed me to my job though, because last Friday it was gone from my job parking lot and I've only been working there a few weeks. I filed 13 though and I got it back yesterday.

I would say 1 year is a long time. It would be interesting to find out if others have held out longer.

Glad to hear you got the car back. Was it your lawyer that helped you get it back or were you able to figure it out and do it yourself?

Well, up until last Saturday I didn't even have an attorney. The moment I realized that my car was gone I called Drive and they said it had been seized and that I would recieve a notice in the mail... Then I started googling... I HAD to find a way to get it back. I drive 50 miles to work each way. So I found something stating that Ch 13's automatic stay would probably be able to stop the auctioning of my vehicle and make the retun of it required. I had already thought about BK once or twice before... and after this happened I really had NO choice because there is no way I could have afforded the payoff. So I got in touch with a well known Houston BK attorney and I filed Saturday. His paralegal called and informed Drive of the Automatic Stay and I went and picked my car up yesterday.

Sounds like you are on the ball!
Before they repossessed your car, was your car parked in a garage, apartment parking lot? As you said, it looks like they followed you to work.

When you found the car was gone, how were you able to get home?

Now the car we had that they tried repossessing, I went and got a different liscense plate for that car and a different one for my truck. I don't know if that will slow the repo man down or not. I know they go by VIN numbers, but if the liscense plate is changed, I don't know if they know about that.
When you moved, did you ever changed States and rerigster the car in the new State?

My car has never been parked in a garage, nor have I moved out of state. I work usually in controlled access facilities where they normally can't get into...until here. At my house my boyfriend usually parks behind me... but that's only for the past 6 months. The 6 months prior to that I was in an apartment complex and they could have taken it anytime. I think they just weren't looking too hard then. My boyfried drove the 65 miles to come get me from work.. Heh.. I racked up the overtime while I waited. I think that the lienholder is informed if you have your license plate changed, since they are still in possession of the title.

Hmmm, do you know if it was a repo tow truck or did the guy walk to the car and drive away with it? In our case, I am sure the repo man had a key (dealer has the key codes) and was going to just drive away with the car, that is if he could find the car. Did you have a 'Club' over the steering wheel?

                  They knocked on our door

We were behind on our lease payments just getting ready to file for out ch7. One night around 3:00AM they came pounding on our door. Yes people the repo men really do exist. We asked if we could have a couple minutes to take out our belongings then opened up our garage for them and handed over they keys. They said thank you and took the car. I suppose if it were in the driveway they wouldn't have knocked at all.

If someone comes banging on my door at 3 in the morning, I highly doubt I will open the door. I barely open the door when it's broad daylight! Are they just trying to make sure you are home? Do these guys not sleep at night?

If you object when they try to take it they can't.

Oh, in answer to your question BigJohn, it was a little blue wrecker that took my car.

Ordinarilly I wouldn't open the door either, but when I realized who it was I just wanted them to leave without waking up the entire neighborhood. It's bad enough that soon there will be trustee sale sign on our house but there's no reason to advertise to your neighbors that your car is being repossesed.

By the way do they actually hang something on your house when it goes into trustee sale? I've read that they do.

I am having a hard time find someone at the bank that can tell me where to surrender my car.
I am not going to deal with the repo guy but just give it up.

I'd just park the car in the parking lot of one of the bank branches and take the keys inside, leave them on the counter, say you're surrendering the vehicle and walk out.
