Ok I spoke to my attorney and he said that this is just the car company's attorney asking to be put on the matrix. They just sent the reaffirmation paperwork. It's not a request for me to go to court.

Actually, the Judge is the person with the power to grant or deny reaffirmation. The lender does not. Yes, the lender wants the loan reaffirmed. But the judge can deny it if he/she thinks that you don't have the means to pay, or that it would be a undue hardship.

If that happens, it isn't necessarily a bad thing. Masda will have been satisfied that you tried to reaffirm. Then you do a ride-through. If you can make your payments and make them on time, you should not have any trouble. I have read of this scenario several times on the Forum.

Still, it is best to discuss this with your attorney as soon as possible.

Hi Freddy, you posted before I got my post in. I am glad you have talked to your attorney. I hope you feel more at ease now.

Hi Freddy - notice of appearance (especially if it's the form filled out) also means that they want to be included on the filing...they may not show up...but they may...at any rate if you're paying for the car, you're paying for the car.

Now, remember, Mazda American Credit is owned by Ford Credit, so they will probably (from what I understand from my atty) WANT a reaffirmation. And as I read from the wiser heads here, as long as you intent to reaffirm, even if the bk judge denies it, it doesn't matter, you've asked for it, you're paying, and that's it.
