    New to all this and really stressed out!

    After experiencing two layoffs in the last 5 years and having our income drop over $30K/year in that time, my husband and I have come to the point where it is necessary for us to file bankruptcy. We staved it off for as long as we could and as of right now are not behind on anything, but that will change as we've depleted our savings. We have enough left to pay our chosen attorney's retainer and then will have to stop paying on our credit cards because there simply won't be enough money.

    We are going to file Chapter 7 but must wait until November due to the 6 month salary issue on the means test (dh's last paycheck from the part-time job he most recently lost puts us over the median; by November, it will have dropped off from the computation and we'll be about $1K under the median), plus we have a huge family trip at the end of October that involves airline tickets that we bought 7 months ago and the fact that we and our extended family are using 3 years' worth of our timeshare allocation for it. This was all planned and booked a year ago before our finances exploded and is non-refundable, plus we'd have to count the tickets as assets, etc.

    Waiting 'til November makes me nervous because our attorney has advised us to stop paying our credit cards and one personal loan (we have two car loans and an additional loan through our credit union that we intend to keep paying -- we want to keep our cars). He also told us that between now and then, we could be sued and my husband's wages garnished for non-payment on our debts. I can deal with the bill collectors calling, but if we end up getting sued in the next 4 months and we lose a huge portion of my dh's pay, I don't know what we'd do. And the uncertainty of it is killing me.

    There's also the uncertainty of being really upside-down in our house (it's worth about $52K and we owe $94K on the first and $14K on a second) and the attorney advising us to stop paying on the 2nd and try to negotiate a payoff with them. We're too scared to do that at this point; plus, we don't have any money that we could offer as a payoff! And a Ch. 13 is out of the question because we wouldn't have enough left over each month to make that payment.

    So when we get done with the BK, we'll still have 2 mortgages, 2 car payments, a personal loan AND my dh's $27K in student loans (he had to go back and finish his degree in order to get the job he currently has, even though it pays a LOT less than his previous one). And an 18yo who wants to start college in the fall.

    If you've made it this far, I thank you, and would welcome any advice/words of wisdom you might feel like sharing!

    I don't have alot of great advice because I'm just now going through the process myself and had my 341 meeting today. *BUT* you have absolutely come to the right place to find everything you need to know and all the support you could ever want. The folks here are amazing and SO wonderful at jumping in to help however possible. I know you will start to figure it all out once you have more information to work with. Hang in there and be strong. If I can survive it this long, then I know you can too. Welcome to the family.

      First of all, the means test is just part one. Did your lawyer fill out schedules I and J to determine if, you have sufficent monthly disposable income to fund a 13? If not, you can file a 7 regardless if you're over the median.
      For sure stop paying all debt you wish to discharge. It'll take months and months before you get sued and there are plenty of ways to delay a trial.
      The object of the bk execrise is to leave bk in better shape than you entered. You don't want to live paycheck to paycheck and you don't want to drag a depreciating asset through bk. You're underwater bk $50K on that house. Consider letting the house go. Stop making mortgage payments and stay there and bank the payments to use for household expenses as well as deposits, etc. when you finally are forced to move.
      Best advice I can offer is get a bit coldblooded about this process and treat it as just a business decision and always act in a manner that reflects your best interest.

          Welcome, we too are just in the beginning stages of a chp 7 filing in late Oct/early Nov timeframe. This site has been a godsend and I have found alot of useful and comforting information out there. Start reading as many of the "stickies" posted under each category, it is very helpful. The preplanning for BK sticky is especially helpful and will make you feel like you actually have a little control in how things will play out if you use a little (or alot I guess) strategy. I have been reading for about a month now, we have had 2 attorney consults during this time and have retained one of them (make sure you feel very comfortable with whomever you choose), we have opened a new bank account with a bank that has no affliation with any of our debt and have transferred all info and direct deposits over. We have also missed our first payments ever this month and 3 weeks after our first missed CC payment we rec'd a letter in the mail (no phone calls yet) telling us that they would like to talk with us and "help" us. We have also setup a google voice account and changed/updated all of our profiles with the creditors with our new google voice phone number, found out about this on this site and you will want to do this, its free. So, start reading and planning out your strategy and your filing date will be here before you know it!

            It is heartbreaking to hear story after story on here about everyone's situation. But...I agree about being a little cold-blooded about it all and just do what you have to do. In DH and my case, we filed for BK and we are losing our house to foreclosure. It was a long, hard decision, but when my husband came to me and said..."I've had enough...let's let it go!" A relief came over me and the weight lifted off my shoulders. Now I'm not saying that it is an easy road, but none of this is. I know as many people going through short sales and foreclosures as those that are selling their homes "the old fashioned way" lol.
            I hope that you can hold onto your house. But just remember that you won't be alone in this if you decide to. This is great forum and you will get great advice. Good luck and God bless.

              Thank you all for the welcomes and advice. It's a relief to know that we're not the only ones going through this.

              I've been reading the stickies and thanks to them and the other threads I've read here, knew a lot of things we needed to ask the attorneys about when we were having our consultations, so thank you to everyone for that!

              We're under water in our house and frankly, I'd love to be able to move out of our neighborhood (we're just outside Detroit and our housing has just tanked here ... 3 of my 6 closest neighbors lost their homes to foreclosure and now we live among renters instead of owners for the first time in 18 years), but I can't imagine letting it go because we'd have to find somewhere else to live! And with 2 dogs, 2 cats, a kid and wrecked credit, I can't believe we could find something better/more affordable than our $622/month mortgage payment. I am sincerely open to any suggestions on that front, though!

                  First off, congratulations on the beginning steps of a stree-free life. My wife and I just recently filed a CH7. Our discharge should be on Sept 1. Our lawyer advised us to do the same as your did. We stopped paying all loans, except for the vehicle and mortgage loans. We did get sued by Discover and Capital One. No worries there. You'll be sued and summoned to go to court. I asked our lawyer what we should do and he said, don't go. He asked me, 1. Do you owe the money? Yes. 2. Do you have the money to pay back? No. The only thing that will happen to you is you will get a default judgment, which will be taken care of in the BK.

                  Living life without credit cards and on cash is awesome! We don't have creditors calling us anymore, we have a financial future and actually have money in the bank for savings. Keep your head up, ask around here (there is a lot of experience and great advice on here), and remember there is light at the end of the tunnel.

                    Thanks for the encouragement! Our attorney told us that if we were sued, there could be a default judgment against us and that my dh's pay could be garnished up to 25%. That is the single thing that is scaring me the most ... if we get a judgment against us with a garnishment even a month before we file, I don't know what we'd do. And my dh's employer would of course find out about our financial state if there were a garnishment ... dh definitely does not want that to happen!

                      Your neighbors who lost there home to foreclosure had to move somewhere. I'm sure many of them had children and pets and bad credit. We've never had anyone on this board say they were left homeless because of a bk.
                      Just look around and see what's available.
                      Don't get hungup on lawsuits. You'll very likely still be in collections by Nov. It takes time for a debt collector to sue and then you'll have time to respond,etc. 4 months likely is too little time for anyone to sue.

                        That's true, they did all go somewhere. One moved across the country with her fiance, one moved into his mother's house, and I have no idea where the last one went. And actually, they were all single. Tons of singles in our neighborhood (it's mostly 2-bd/1 bath brick tract homes built in the 40's ... we have an addition and have 3 bd/2baths) 'til the housing crash ... now there are a lot of young families, all renters.

                        We have been looking and so far have found nothing out there that is cheaper than our $622 mortgage (even if you add in our $218/mo 2nd mortgage). That doesn't mean we'll stop looking and we are still open to it, but we can't see an option that's better than where we are at this point.

                        And I absolutely hope you're right about 4 months being too little time for a lawsuit ... crossing my fingers like crazy, because our lawyer definitely prepared us for the worst on that front.

                          Hi---Brennan---for what it's worth---chances are very slim that the credit card companies
                          will start suing you within the next four to five months---and it's usually after six that they
                          can get aggressive---and then there's the response time---and the court date---and by
                          then---you will have most likely filed for bk---so that you won't have to worry about judgments.

                            Our attorney also told us that we have at least (in most cases) 6 months into it before the creditors start anything serious (ie: lawsuit). Keep looking for a rental situation, with all of the BK's and FC's going on right now there are alot of people renting. Landlords are a little more tolerant of your situation and probably have many more tenants with the same history. You may have to put down a bigger deposit in the beginning but if you can sign a lease ahead of time (maybe 2 months ahead) and pay the deposit off in installments by move in date or something like that. With your 1st and 2nd mtgs, utilities for a house, upkeep, repairs etc. all added together you might be surprised in that renting could be a stress reliever in the long run.
