    Trustee Information Request

    Got this email from my attny today, trustee wants information within 15 days:
    An accounting for any portion of the 2009 and2010 tax refunds, how spent, to whom paid, the amount and date, the contact information of any payee and their relationship to you (if any).

    Because your refunds were substantial for 2009 and 2010 the trustee wants to know how they were used. Specifically did you pay off any large debts, repay loans to any relatives, loan money to relatives, is anyone holding money for you, etc. If you spent the money for living expenses etc. that's ok. If you paid any one unsecured creditor more than $600.00 within 90-days of your bankruptcy thats not ok.

    We already told the trustee this at the 341 regarding the 2010 return, and why are they asking about 2009? Any ideas?
    Filed ch 13 12/23/10; closed 3/14; refiled ch 7 on 4/13; 341 on 5/13; reaffirmation 7/11 (denied); 7/14/11 DISCHARGED

    we were also asked not just for 2 years, but three, so this is really not that unusual. and those questions,

    are asked many times. so they aren't off the wall.

    don't fret if you can't find all the receipts, really since someone is asking you how you spent your money over 2 years ago, and produce receipts on your tax refund money, when, most people if they get their tax return and go on vaca, or use it for some other luxury item, not thinking what's going to happen in two years and since they aren't expecting to filing bk 2 years later, many times don't have those receipts lying around.

    i would give them what you have, and then send a written affidavit as to where and how the money was spent.

      Thanks - I certainly don't have receipts lying around. nor did I go on vacation! I was pregnant and saving time for baby#2! I think most was living expenses, but I'll have to check my checking ledger to see what we did around that time. I hardly use cash, just the check card.

        then that's perfect, i would just make copies of your checking account ledgers and statements and you should be fine.
