    Filling by myself while married

    How hard is it to file by yourself while you are married what are the things I need to know and how do they work what i have to pay out with mine and my husband income we have no bills together.

    It depends on the laws of your state. I am filing alone though married. My husband and I have largely separate accounts. His are not affected by my filing. His income is counted (as his is the only income!) and his expenses are listed. The vehicles are in his name only (always have been) but my atty is listing the van as "mine" though in my husband's name, b/c he thought it wise to show some sort of vehicle on my petition.

      I filed individually and I'm married. The only thing I shared with my DH was a checking account. The rest of the debt, medical bills and house were in my name. As pp mentioned they use spouses income and subtract their expenses not contributed to the household (their cc or student loan payments, etc).
      Stopped paying 8/2010, Filed 2/2011, 341 3/2011 done, Report of no distribution . . . Discharged & Closed 5/2011!

        many people file 'single" as opposed to married. when i had a business, my business partner did with no problem.

          i'm filing alone without my husband. We also only have a joint bank account together. The house is in his name alone.. I have a car in only my name.. nothing we have has both of our names on it besides the bank account. The reason I'm filing has to do with my ex husbands stupidity... no reason to bring my husband into it! They just had to include my husbands income for the means test... they did have to list the things in his name under bills and everything. But I'm only filing on my stuff and he will not be effected by it.

            Thank you for all you input it really helps...one more question the only thing that has both are names is the house but it is paid for and a joint banking account...will the house be affected being that it is paid for?

              You would need to know the value of the house (and it may need to be pretty official and accurate in this situation) and then half of that equity would be your asset. In SC you can exempt 53,375 for your homestead. If you have more equity than that then you may have the ability to buyout the remaining portion of equity. The trustee might also abandon it if it isn't worth his time.

              The bank account may be an issue if you use all your homestead exemption and there is a lot of cash in it. Half of it will be considered yours on the day of filing and be an asset unless you can exempt it somehow.
