    Non-Consumer MEANSU flag post 341

    Hi, two weeks ago I had my 341 - no problems, very uneventful. UST asked nature of debt (guarantor on 700g commercial property note) Only thing missing was 2010 return - filled that night - owe $3600 buck to the IRS .. great.

    Obsessively checking PACER and keep seeing "MEANSU" flag. Nothing else. Is this typical for a non-consumers cpt7? I was under the impression that the there should be no flag as I didn't have to take the means test.

    It's hard to determine since some of the flags are only used in some Districts. Apparently, your District uses the MEANSU flag (Means Unknown) for non-consumer cases. They will probably remove that flag once the UST has reviewed the case. This may take up to the 60 days following the first scheduled 341 Meeting (the dischargeability bar date).

    Remembers, the Means Test is one thing, and the ability to provide a meaningful dividend to creditors in a Chapter 13 is another thing. MEANSU is really about abuse.

    I would not worry about it unless you have a DMI (disposable monthly income) over $2K.

      Our DMI is right around 1500 - 2000 gs. The Trustee was very cool and didnt have any questions from the UST. Oddly as soon as the 341 was over our Lawyer said "Your done! should be discharged within a month! If the UST had no questions at this point its over"... I told my wife he was wrong - any f*ing thing could happen.
