    Day 61 and a Question

    So today is day 61 after my 341. Not expecting anything on PACER, however, do have a question:

    Assuming nothing adversarial has been posted on PACER is it safe to assume there are no objections and I am merely just waiting on the paperwork? I ask this because being in L.A. everything is backed up (we were told to not to expect discharge for 4-5months after 341) I just don't want to think we are in the clear to find out that the paperwork was sitting someplace and just didn't get entered into PACER late even though it was filed or received by the court within the 60 days. Does that make sense?

    Thanks again as always for all the insight and guidance, this forum has been a life saver!!

    Hi winterheart,

    If the trustee/UST hasn't said anything to you by now, you are in the clear!

    Your discharge should be "forthwith" ....which apparently can be months some places.

      I am from L.A. too and I asked my lawyer if for example I find a high paying job 60 days past the 341, can the trustees or creditors come after me and reverse my ch 7 or take some of my wages. He said no, you are in the clear. So you are basically in the clear right now (unless of course they found some major mistake or misreporting you did).

      I believe it took over 90 days past the 341 for me to be discharged and that was just a few months ago. It could take even longer for you, so stay patient.

        Thanks much for the insight! My lawyer told me "there's nothing to do but wait for a good 4-5 months. Then your debts will be discharged and you have a fresh start." So i figured we wouldn't have any news for a while but I wanted to know if I was just waiting for the "official stamp of approval" or whether like 80 days out they finally got around to looking at the case and say "oh look here the U.S. Trustee filed this on day 24" so then things get thrown. Looks like we are probably good just waiting on the official word. Also if you don't mind me asking did your case close yet and/or did that happen close to discharge?

          I believe my case closed immediately after the discharge. I decided not to sweat anything after the 60 day period. I never checked pacer either, I just waited patiently. I have to admit, it feels great when its done. Hang in there.

            Yeah sometimes I wish I never knew about PACER LOL. I mean on one hand it's nice to have an idea where things are but checking it everyday can driving you nuts!!! Thanks again for the insight!!

              You are welcome, it's not like I haven't asked dozens of questions on this board throughout my bk either. That is what is so nice about this board, there is always someone or many that have gone through exactly what you have gone through and can share their experience.

              Remember when you first were considering filing bk, how incredibly scary it was? Now it seems like no big deal at this stage.
