Trustee and state tax return...SO frustrating!!!

We have been making payments on our 2009 state taxes for the past year.

I received a letter from the state tax commission yesterday stating that they cannot accept my payments while we are in bankruptcy.

This may screw up our plans. Our plans were to get our federal return back and pay off state with the majority of the rest before our 341 meeting (We still owe $1k from last year and 600 from this year). Our attorney said that he didn't think the trustee would fight this because it is another department of the state.

However, if they won't accept the payoff, I am wondering if the trustee will take the federal return that we do get back because it will still be there and not gone to state taxes. It doesn't make sense because it will put us right back into debt! But, I wonder if that matters (remember, my trustee known for being a total d***!)

I emailed my attorney and explained the situation and that we needed to try and argue it if he did demand he receive the tax return, but I am not sure if there is a point to that. There are so many other things that we may be arguing.

I'm so frustrated. This case is such a pain in the ass. I am so sick of it and wonder when it will be over!
