    I hope so, my attorney is really short with me... and I don't mean height wise. Well i guess we will see what happens, is a Judge going to be there or is something with only the trustee?

        Agreed with all others. You are panicking over nothing. If all of your creditors are "institutional" type creditors I will bet dollars to donuts the ex-husband has something to do with the allegation of "under the table income". Could be wrong but. . . I've seen this many times. Depends upon the relationship between the ex spouses.

        Sounds like all is in order and once you attend the continued 341 (not a 2004 exam) and explain all you will be fine.

          Thanks for the help, I am really good friends with a sheriff who I hand out with or talk to every day and he said we would back me if it goes that far. I am a little less worried today but its the whole aspect of not knowing what is going on. When I talk to everyone they think it is my landlord. How else would a creditor say that I am working under the table, so I am going to meet with the attorney on Friday and going to the 341 Meeting again on Monday. How long can the trustee keep calling us back? Can a trustee drop the case?

            I'm just slightly baffled by your concern over them hiring a PI to follow you. So what if they did?? A PI can follow me all day long, just gonna be a waste of money. What are you worried about? I will just say this: if you ARE working under the table and it is even remotely conceivable that someone could have tracked that activity, you'd better be very, very careful here. Particularly if you owe money (say, to the landlord) to someone who knows you personally and does/could know about your under the table work. Loose lips sink ships.
            If you've EVER told something to someone else, you'd better tell it to the trustee...

                  I don't think you are going to need the sheriff on this one, doubt the 341 will get that wild...

                  Its still in front of the trustee, if it graduates to judge level you will get notified of an "adversay proceeding"

                  But I'll bet you have a better chance on a Lotto ticket than this getting that far.

                    Okay, So I had the another 341 hearing today and it was my landlord.... I feel so bad for declaring them..... Question can they sue for damages? We left the property last week?

                    Our 341 hearing had been continued due to our 2010 taxes .... Will this delay the discharge?

                      Hi calco,

                      No suit for damages on anything before your file date, you just owe rent between file date and vacate date.

                      In theory, the continued 341 doesn't delay discharge, the 60 day deadline for creditor objections is from the 1st scheduled 341.
