Our 341 is coming up on 10/05 in Florida and we are keeping the house, will reaffirm if necessary as we have quite alot of equity in it. We deceided to put it on the market and move back up north closer to family. How long do you have to wait after the 341 to put it on the market? Do we have to wait till discharge?

You need to wait until you're discharged and closed before you sell. Up until discharge, all your assets are still property of the bk estate and you'd need the trustees permission to sell. -
Keepmine is right. Also, if you lived in another state besides Flordia or Texas, the trustee would possibly be able to sell the house.
If you absolutely need to sell the house earlier, then you might be able to get the Trustee to agree to abandon the house. You could also file a motion with the court to compel the trustee to abandon the property.I am a bankruptcy attorney practicing in Riverside and San Bernardino Counties.
