    What happens after filing?

    Now that my case was filed last Friday, I have a few questions.

    How long does it take for creditors to be notified of the filing? I'm expecting a student loan disbursement next week and wasn't sure if they would be notified by then. I'm assuming they would be, but hopefully it won't delay the disbursement.

    I have read about WF freezing bank accounts or CU freezing accounts where debt is owed, has anyone had a problem with a CU freezing or closing an account where no debt is owed? I opened up a new CU account a few months ago, but am concerned about leaving money in there if they may freeze the account.

    I noticed on pacer that my attorney listed my monthly earnings about $300 less than they actually are. I am well under the medium either way, but should I notify my attorney of the error? Lastly, is there anything else that may happen between now and the 341 that I need to know about? TIA for your help.

    Well, since I just went through this a month ago...

    1) Some of the creditors are notified by mail, some are notified by email (at least in my district). They were all notified within 5 business days.

    2) Don't worry about it. If you don't owe them any money they won't freeze your account. There have been problems with Wells Fargo (could be BOA) freezing accounts for sh!ts & grins. My CU (who I have a car loan with) did not freeze my account as I intend to reaffirm the loan and that intention was noted on my petition.

    3) Let the attorney handle it (the earnings). I'm sure they had a reason for listing it like that.

    4) If your attorney/trustee needs anything. You'll be contacted. Sit tight & watch the mail/email.

      It took about a week for my creditors to stop calling so I'd assume it took that long for them to get the notice.

      We had NFCU and they closed all our accounts, seized the assets ($13.99 - after we switched to another bank), and sent us a request for us to mail our credit cards back to them. We switched banks the day we filed so our money would be safe.

      They may have listed your earnings as the 6 month average? Ours did that because DH gets paid by the job, not by the hour. Some weeks are better than others so they used the average for our filing.

        Thanks for your responses. I haven't received calls since I notified the creditors that I retained an attorney a month ago. Hopefully everything will go smoothly with the student loan distribution, since they will know about the bk.

        As for the CU, I was only concerned because I defaulted on 2 line of credits from a local CU and joined another local CU a few months ago. Hopefully they don't communicate with each other, although I'm sure they have better things to do! ;^)

        That makes sense about the salary, I will just leave it as is. Thanks again for your help. I look forward to being done with the 341!
