    How to add a plaintiff to schedule F??

    Background:

    I filed for chapter 7 bankruptcy on April 29th and currently have a Stay in my name.

    On May 9th I received a court summons stating that I am being sued for injuries that occurred when a skier collided with me over a year ago. This came unexpected and I haven't heard anything about this until May 9th.

    Question:

    After talking with attorneys and the bankruptcy court, I am told I can get this added to the bankruptcy. I need to file an amendment to schedule F and add the plaintiff as a creditor.

    How do I do this? Do I list the attorney of the plaintiff, the plaintiff, or both? I don't have the address for the plaintiff, only the attorneys address.

    Also, the rules for the creditor matrix state that I can't add an attorney to the creditors matrix.

    --I would call and speak with the bk clerk and find out your districts procedure for amending the schedules. You will have to follow your local rules. I believe adding the attorney for the plaintiff will be sufficient.

    Also, the rules for the creditor matrix state that I can't add an attorney to the creditors matrix.

    --I can only guess that you can't amend the mailing matrix because now that you have filed your bk its your responsibility to notify any new creditors of your bk. This is the way it works in my district at least. Once again, a call to the clerk should clear this up.
