Attended the 341 meeting last week on Thursday. I used a bankruptcy petitioner to prepare my petition and I guess my trustee really doesn't like my petitioner. The trustee talked to me as if I was a hostile witness in a criminal case. It was the worst experience of my life. I really don't think she should be able to treat people like that. I notice she called everyone else in order according to their last name, but me and one other girl (the same petitioner did her paperwork) was left for last. I was so mad about the way she treated me I don't even remember what I said in response to her questions. I want to know is there a way I can complain about her. She treated the other girl the same way. I don't trust her. She seemed mad at me because my filing fee was waived. She said I guess you had just enough money to pay your petition preparer but your filing fee was waived so how am I going to get paid. Can she try to sell my car? Its paid in full but the VA exemptions are enough to cover my equity. She shouldn't be allowed to be a trustee if she treats people the way she treated us.

This seems to be a rarity, but unfortunately you would probably do yourself a dis-service attempting to dump that person. Her statement of "not getting paid" says it all. She just may want to dump you fast so I'd hold on and see. If that smart azzed remark was all she told you, you probably will float through just fine. I'll wager she was more upset about the cost waiver than the paper filer. 'HubIf I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.

The trustee may have been rude to you, but she still has to follow the law when it comes to dealing with your assets and debts. She can't take anything more than the law allows.
If you decide you want to file a complaint about this specific trustee's "courtside manner" *AFTER* your case discharges, you can do so by contacting your local US Courts region's regional office - you can find your regional office's contact information here - http://www.justice.gov/ust/eo/ust_or...n_websites.htmI am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
